Firestone Traffic Revision Act (2019)

§ 0.

  1. The Firestone Traffic Act shall be repealed and replaced. The contents shall be replaced by the below. Regardless thereof, the official title to reference the below shall be ‘Firestone Traffic Act’ and not ‘Firestone Traffic Revision and Repealment Act’.

PREAMBLE
To better organize traffic laws and regulations.
All road and track users (including pedestrians, bicycles, motor vehicles, and trains) fall under ignorantia juris non excusat, and are obligated to know and understand all traffic laws listed in this Act and any other Act enforcing traffic laws.

Chapter 1. Main Driving Infractions

§ 1.

  1. ‘Reckless Driving’ shall be an illegal traffic infraction (for the first two offenses) and misdemeanour (for the third offense and above) in Firestone. Reckless Driving shall be defined as: “driving a motor vehicle with a malicious disregard for traffic rules or other road users, which is likely to cause an accident involving another road user or did cause an accident involving another road user”.
  2. Any person charged with Reckless Driving shall receive the following punishment:
    a. First offense: $250-300 citation.
    b. Second offense: $400-500 citation.
    c. Third offense and above: Jail time of 100-300 seconds.

§ 2.

  1. ‘Careless Driving’ shall be illegal in Firestone. Careless Driving shall be defined as: “driving a motor vehicle with disregard for traffic rules or other road users, which is likely to cause an accident involving another road user or did cause an accident involving another road user”.
  2. Careless Driving cannot be a charge alongside Reckless Driving.
  3. Any person charged with Careless Driving shall receive the following punishment: $150 to $250 citation.

§ 3.

  1. ‘Distracted Operation’ shall be an illegal traffic infraction in Firestone. Distracted Operation shall be defined as: “driving a motor vehicle at a speed greater than 0s/s or operating a bicycle at a speed greater than 0s/s while operating an in-game phone, camera, or protest sign”.
  2. Radar guns and similar speed measuring equipment operated by on-duty law enforcement officers shall not be considered a distracting object.
  3. Any person charged with Distracted Operation shall receive the following punishment: $50 citation.

§ 4.

  1. ‘Making an Illegal U-Turn’ shall be an illegal traffic infraction in Firestone. Making an Illegal U-Turn shall be defined as: “making a u-turn when unauthorized to do so by signage or road markings; or in such a manner as to endanger other lawfully operating road users; or when doing so over a median, central island, or other object not designated for vehicles/bicycles; or in a prohibited manner as prescribed in this section.”.
  2. ‘Signage or road markings’ shall be defined further in this Act.
  3. A u-turn may not be made when the vehicle/bicycle is within 100 approaching studs of any intersection, unless they are in a center left turn lane where u-turns are permitted, are using the intersection itself (while not violating any other road rules or signage/road markings), or are using an intersection or property exit/entrance within 100 studs of the other intersection in question when u-turns at such intersection are permitted.
  4. ‘U-turn’ shall be defined as making such a turn with a bicycle or vehicle that it faces the opposite direction after completing the turn.
  5. Any person charged with Making an Illegal U-Turn shall receive the following punishment: $40-$60 citation.

§ 5.

  1. ‘Doing Drift Burnouts’ shall be an illegal traffic infraction in Firestone. Doing Drift Burnouts shall be defined as: “intentionally or negligently drifting (either while stationary or moving) causing a burnout and causing smoke to evolve while operating a motor vehicle or bicycle”.
  2. Any person charged with Doing Drift Burnouts shall receive the following punishment:
    a. First offense: $80 citation.
    b. A second offense and above: $120-$150 citation.

§ 6.

  1. ‘Driving a Vehicle with Disabled Tires’ shall be an illegal traffic infraction in Firestone. Driving a Vehicle with Disabled Tires shall be defined as: “driving any motor vehicle above 0s/s with flat or disabled tire(s) without taking due precaution(s)”.
  2. ‘Due precaution(s)’ shall be defined as heading to a parking space to halt the vehicle as soon as possible and staying on the shoulder lane or, where there is no shoulder lane, on the rightmost lane to not hinder traffic.
  3. Any person charged with Driving a Vehicle with Disabled Tires shall receive the following punishment:
    a. $50 citation, and
    b. Prohibition to operate the motor vehicle in question until the tires are no longer flat or disabled. Violating this mandate shall result in any applicable charge(s), such as Failure to Comply.

§ 7.

  1. ‘Driving without Headlights’ shall be an illegal traffic infraction in Firestone. Driving without Headlights shall be defined as: “driving (above 0s/s) any motor vehicle or bicycle at night or in poor weather conditions without headlights being switched on”.
  2. ‘Poor weather conditions’ shall be defined as rain, fog, smog, mist, snowfall, or any condition which impairs vision ahead substantially.
  3. Bicycles shall be exempt from this infraction if they are not equipped with a light.
  4. Any person charged with Driving without Headlights shall receive the following punishment:
    a. $20-$40 citation.

§ 8.

  1. ‘Driving Backwards into Traffic’ shall be an illegal traffic infraction in Firestone. Driving Backwards into Traffic shall be defined as: “driving a motor vehicle or bicycle in reverse when traffic is behind them or they are endangering potential traffic by driving in reverse for a long period of time without real purpose”.
  2. Drivers shall be exempt from this law if they are reverse (parallel) parking into a parking space. Traffic behind them must make way for the vehicle to reverse park, or else be guilty of Failure to Yield.
  3. Any person charged with Driving Backwards into Traffic shall receive the following punishment: $70 citation and $120 citation on roads with a speed limit at or above 70s/s.

§ 9.

  1. ‘Failure to Drive on the Correct Side of the Road’ shall be an illegal traffic infraction in Firestone. Failure to Drive on the Correct Side of the Road shall be defined as: “driving or operating a bicycle with the front of the vehicle facing the incorrect direction in traffic”.
  2. ‘Incorrect direction’ shall be defined as at least half of the vehicle being opposite to the orderly and legal flow of traffic. This is to be ordered by on-duty law enforcement, DOT/DPW, or SCFD; road signs or markings; or, (as a basic rule) on the right-hand side of the road.
  3. Any person charged with Failure to Drive on the Correct Side of the Road shall receive the following punishment:
    a. First offense: $200 citation.
    b. A second offense and above: $300 citation and a Reckless/Careless Driving charge (or Recklessly Operating a Bicycle if a bicycle).
  4. Failure to Drive on the Correct Side of the Road cannot be a charge alongside Driving Backwards into Traffic, unless it is in respect to a separate situation.
  5. This section shall be null if it is in respect to chapter 3 § 2(13).

§ 10.

  1. ‘Failure to Yield’ shall be an illegal infraction in Firestone. Failure to Yield shall be defined as: “failure to yield the right-of-way to vehicles, bicycles, or trains which have the right-of-way”.
  2. ‘Right-of-way’ and relevant information shall be defined further in this Act.
  3. Failure to Yield cannot be a charge if there is already a charge specifically for the offense committed. This includes if a vehicle/bicycle stops at a stop sign but then fails to yield when pulling out into the intersection; this counts as Running a Stop Sign, not Failure to Yield. This does not count for any offenses related to failing to yield to trains.
  4. Any person charged with Failure to Yield shall receive the following punishment: $50 to $250 citation depending on the situation (failure to yield to emergency vehicles with activated emergency lights shall always be a citation of $250).
  5. Pedestrians may be cited for Failure to Yield.

§ 11.

  1. ‘Failure to Yield to Pedestrians’ shall be an illegal infraction in Firestone. Failure to Yield to Pedestrians shall be defined as: “failure to yield the right-of-way to pedestrians which have the right-of-way”.
  2. ‘Right-of-way’ and relevant information shall be defined further in this Act.
  3. This charge can be a charge alongside any other charge, including Running a Red Light for example (if a vehicle runs a red light and hence fails to yield to pedestrians attempting to cross, this shall be an added charge).
  4. Any person charged with Failure to Yield to Pedestrians shall receive the following punishment: $100 to $270 citation.

§ 12.

  1. ‘Running a Red Light’ shall be an illegal infraction in Firestone. Running a Red Light shall be defined as: “‘passing’ when a red aspect is shown on a traffic signal directed towards the vehicle or bicycle in question when unauthorized to do so”.
  2. ‘Passing’ in this section shall be defined as:
    a. The front tire(s) of a motor vehicle or bicycle passing the stopline (dedicated to the traffic signal) in its entirety.
    b. Where a stopline is absent, the front tire(s) of a motor vehicle or bicycle entering the beginning of the crosswalk’s (dedicated to the traffic signal) location.
    c. Where a crosswalk and stopline is absent, the vehicle moving in any manner as which could obstruct or interfere with road users given the right-of-way by traffic signals in other directions at that specific intersection.
    d. When none of the above requirements are met, the requirements set in c. of this subsection shall take effect.
  3. ‘When unauthorized to do so’ shall be defined further in this Act.
  4. ‘Stopline’ and ‘crosswalk’ shall be defined in chapter 3 § 3(1) and (5) respectively.
  5. The stoplights at the following intersection in Stapleton County version 2 shall have no legal effect; default right-of-way rules shall apply at the following intersection (Running a Red Light shall not apply): Lincoln Street & Prominence Boulevard, where Lincoln Street splits off in a T shape (left and right).
  6. Any person charged with Running a Red Light shall receive the following punishment: $100 to $150 citation. Any person charged with Running a Red Light for failure to stop appropriately before making a right-on-red where allowed shall receive the following punishment instead of the abovementioned punishment: $50 to $120 citation.

§ 13.

  1. ‘Running a Stop Sign’ shall be an illegal infraction in Firestone. Running a Stop Sign shall be defined as: “‘passing’ when a stop sign is shown directed towards the vehicle in question before coming to a complete stop reasonably before the intersection and yielding to other traffic as required”.
  2. ‘Passing’ in this section shall be defined as:
    a. The front tire(s) of a motor vehicle or bicycle passing the stopline (dedicated to the stop sign) in its entirety.
    b. Where a stopline is absent, the front tire(s) of a motor vehicle or bicycle entering the beginning of the crosswalk’s (dedicated to the stop sign) location.
    c. Where a crosswalk and stopline is absent, the vehicle moving in any manner as which could obstruct or interfere with other legally operating road users at the intersection.
    d. When none of the above requirements are met, the requirements set in c. of this subsection shall take effect.
  3. ‘Yielding to other traffic as required’ shall be defined further in this Act, specifically chapter 5.
  4. ‘Stopline’ and ‘crosswalk’ shall be defined in chapter 3 § 3(1) and (5) respectively.
  5. § 13 of this chapter shall not apply to handheld stop signs, stop signs mounted on any movable barrier, or stop signs with supplementary text indicating a simple prohibition for certain vehicles.
  6. Any person charged with Running a Stop Sign shall receive the following punishment: $90 to $120 citation.

§ 14.

  1. ‘Speeding’ shall be an illegal infraction in Firestone. Speeding shall be defined as: “driving or operating a bicycle faster than the speed limit”.
  2. Speed limits are posted signs (as per chapter 7) or LED/digitally illuminated signs which indicate the speed limit in s/s. The speed limit enters effect where the sign is posted and the effect is nullified when another sign overrides the speed limit.
    a. The speed limit on Residential Road, Harrison Street, 109th Avenue, 110th Avenue, and Arapahoe Street is 40s/s.
    b. The speed limit on the section of 108th Avenue between Residential Road and the intersection with Savage Road is 70s/s.
    c. The speed limit on the section of Outland Road between both of the intersections with 98th Avenue is 70s/s.
    d. The speed limit on the FS 401 Highway is 80s/s.
    e. The speed limit on the FS 98 Highway is 70s/s.
    f. These specific speed limits (a-e) shall only take effect in Stapleton County version 2.
    g. These specific speed limits (a-e) shall only take effect if, upon entering the roads in question, there is not any clear signage indicating a lower speed limit.
  3. ‘s/s’ in this Act is Studs Per Second (also known as SPS)
  4. Vehicles/bicycles are permitted to speed up to 5s/s above the speed limit.
  5. Where there is no marked speed limit in Stapleton County version 2, the speed limit shall be 50s/s. Where there is no marked speed limit in Stapleton County version 3, the speed limit shall be whatever speed the driver maintains full control of the vehicle and is able to come to a safe stop and perform evasive action proficiently.
  6. Should a vehicle/bicycle speed at an irregular value not equaling a multiple of ten, the number shall be rounded to the nearest ten unless the vehicle/bicycle is going only 5s/s above the speed limit, whereby the vehicle/bicycle is exempt from speeding.
  7. Any person charged with Speeding shall receive the following punishment:
    a. 10 above the speed limit: $40 citation.
    b. 20 above the speed limit: $60 citation.
    c. 30 above the speed limit: $80 citation.
    d. 40 above the speed limit: $100 citation.
    e. 50 above the speed limit: $120 citation and a charge for Reckless Driving (or Recklessly Operating a Bicycle for bicycles).
    f. 60 above the speed limit: $140 citation and a charge for Reckless Driving (or Recklessly Operating a Bicycle for bicycles).
    g. Increasing by $20 and including a charge for Reckless Driving (or Recklessly Operating a Bicycle for bicycles) every 10 above 60 above the speed limit.

§ 15.

  1. ‘Tailgating’ shall be an illegal infraction in Firestone. Tailgating shall be defined as: “driving/operating a bicycle too close to another vehicle/bicycle ahead”.
  2. ‘Too close’ shall be defined as any distance whereby, if the vehicle/bicycle ahead conducted full braking, the vehicle/bicycle behind would be unable to brake in time.
  3. Vehicles/bicycles shall be exempt from this if the vehicle/bicycle ahead made an unsafe lane change in front of the vehicle/bicycle or the vehicle/bicycle ahead made an unnecessary ‘brake check’. Nevertheless, the vehicle/bicycle behind the vehicle/bicycle ahead must ensure a safe distance is made again.
  4. Any person charged with Tailgating shall receive the following punishment: $80-$120 citation.

§ 16.

  1. ‘Violating a Railroad Crossing’ shall be an illegal infraction in Firestone. Violating a Railroad Crossing shall be defined as: “passing a railroad crossing or attempting to do so when not authorized to do so".
  2. ‘When not authorized to do so’ and ‘passing’ in this section shall include any of the following:
    a. The front tire(s) of a vehicle or bicycle passing the stop line of a railroad crossing or, where absent, the extension of the crossbuck’s location onto the roadway or, where absent, 10 studs before any tracks when the red warning light(s) are flashing or/and the gate(s) are down.
    b. The front tire(s) of a vehicle or bicycle passing the stop line (or as otherwise determined as ‘running a red light’ in § 12) of a traffic light in the operation of guarding a railroad crossing when the light is red unless authorized to do so by signage or rules set out in chapter 5 § 3 (e.g. turning right on red when allowed to do so). An additional charge of Running a Red Light shall be added.
    c. The front tire(s) of a vehicle or bicycle passing the stop line of a stop sign or, where absent, 10 studs before any tracks at a railroad crossing for the purpose of guarding the railroad crossing without coming to a complete stop first and yielding the right-of-way to traffic and trains. An additional charge of Running a Stop Sign shall be added.
    d. Entering any area at or nearby the tracks which could hinder, impede, endanger, or cause a coming train to slow down purely because of the hindrance. The crossbuck signifies the obligation to yield the right-of-way to trains and so does a combination of a yield sign therewith; however, where these are absent, the right-of-way must still be yielded to train(s). This counts for pedestrians, bicycles, and vehicles.
    e. Failure to obey signals given by governmental employees or any railroad employee for the safety of yourself or others at a railroad crossing (this may include other charges on top of Violating a Railroad Crossing).
    f. Blocking a railroad crossing in any manner which could hinder, impede, endanger, or cause a coming train to slow down purely because of the hindrance or entering any area not designated for blocking (marked by signs and road markings) due to waiting, stopping, or parking at any time. Any additional charges can be added onto this as necessary. This shall apply to pedestrians, vehicles, and bicycles.
    g. Entering any area at or nearby the tracks which could hinder, impede, endanger, or cause a coming train to slow down purely because of the hindrance when the red warning light(s) are flashing or the gate(s) are down, or attempting to do so. This counts only for pedestrians.
  3. A crossbuck is an x-shaped sign with ‘RAILROAD CROSSING’ on it.
  4. All buses operated by the Department of Transportation must treat any and all marked or unmarked, technically or not technically secured railroad crossing as a stop sign. Failure to come to a complete stop before the stopline or, where absent, the extension of the crossbuck’s location onto the roadway or, where absent, reasonably before the gate(s) designated for securing or, where absent, before any tracks shall count as Violating a Railroad Crossing.
  5. ‘Railroad crossing’ shall be defined as any place where railroad track(s) cross any roadway, bicycle bath, pedestrian way, or other path, so long as there is a leveled continuation of the pathway in question over the railroad track(s).
  6. Any person charged with Violating a Railroad Crossing shall receive the following punishment: $100 to $170 citation. Should the person in question cause the train(s) in question to conduct an emergency brake due to purely their hindrance, the person in question shall receive a $250-$350 citation and/or an arrest of 60 seconds instead of the aforementioned punishment of $100 to $170 citation. It must be clearly established that the train’s emergency brake was necessitated in accordance with Department of Transportation policy and reasonable ascertainment. Any additional charges (such as Failure to Yield) may be annexed.
  7. ‘Emergency brake’ in this section shall be defined as the train conducting such a brake, in which the train in question must come to a complete stop before being able to release the brakes.

Chapter 2. Miscellaneous Driving Infractions

§ 1.

  1. ‘Violating Road Markings or Signage’ shall be an illegal infraction in Firestone. Violating Road Markings or Signage shall be defined as: “the act of operating a motor vehicle or bicycle while violating any markings on the road or legally placed signage directed to the motor vehicle or bicycle in question”.
  2. Specific definitions and purposes of different road markings shall be defined in Chapter 3 of this Act.
  3. Specific road signage shall be defined in Chapter 7 of this Act.
  4. This charge cannot be a charge if there is already a more specific charge for the offense committed. For example, a vehicle which passes a double yellow line to overtake another vehicle is guilty of Making an Improper Turn or Lane Change, not Violating Road Markings or Signage.
  5. ‘Legally placed’ are mainly signs placed by the Firestone Development Team for the purposes of regulating road users.
  6. Any person charged with Violating Road Markings or Signage shall receive the following punishment: $25 to $125 citation.

§ 2.

  1. ‘Failure to Obey the Move Over Law’ shall be an illegal infraction in Firestone. Failure to Obey the Move Over Law shall be defined as: “failure to move over or slow down as appropriate when approaching employees’ vehicle(s) on the road”.
  2. Vehicles must maintain a parallel distance equal to one road lane from employees’ stopped vehicle(s) with either flashing emergency, amber lights, or hazard lights activated on the side of the road unless there is a physical barrier (which cannot be walked over without jumping) between the stopped vehicle and the vehicle in question.
  3. If vehicles/bicycles are unable to maintain such distance safely, they must slow down to:
    a. 30s/s where the speed limit is 50s/s or less
    b. 50s/s where the speed limit is 60s/s or more
  4. Employees (in this section) shall be defined as any Department of Transportation, Department of Public Works, Stapleton County Fire Department, Stapleton County Sheriff’s Office, Firestone Department of Corrections, Firestone Department of Homeland Security, Firestone National Guard, or Firestone State Patrol employees, vehicles, or cones/barriers placed by these persons.
  5. Any person charged with Failure to Obey the Move Over Law shall receive the following punishment: $50 to $250 citation. A $250 citation must be imposed of the employees’ vehicle in question is a bus.
  6. Should the person in question pass multiple stopped employees’ vehicles in a short amount of time (in the same immediate area), it shall count as one offense.
  7. Should there be no clear marking of lanes in an area near stopped employees’ vehicle(s), there is no requirement to move over or slow down, but the driver must be extra vigilant. Should the driver cause some kind of collision due to not slowing down or moving over in these areas, they shall be liable for any other charge(s).

§ 3.

  1. ‘Improper Use of Hazard Lights’ shall be an illegal infraction in Firestone. Improper Use of Hazard Lights shall be defined as: “failure to use hazard lights (blinking lights on both the right and left side) when required (by chapter 3 § 3(2))” OR “using hazard lights on a vehicle for no apparent reason”.
  2. ‘No apparent reason’ shall exclude:
    a. The usage mandated in chapter 3 § 3(2)
    b. When the vehicle is moving slowly due to a mechanical fault (at the side of the road).
    c. When the vehicle is stopped at the side of the road.
    d. Any other usage for the purposes of warning other traffic of a possible hazard.
  3. Any person charged with Improper Use of Hazard Lights shall receive the following punishment: $20 citation.

§ 4.

  1. ‘Improper Use of Signals’ shall be an illegal infraction in Firestone. Improper Use of Signals shall be defined as: “failure to use turn signals or indicators when switching lanes, turning, making a u-turn, exiting a roundabout, merging into traffic, or entering parts of the roadway from other parts of the roadway at least 1 second prior to making the action” OR “using the incorrect turn signal when switching lanes, turning, making a u-turn, exiting a roundabout, merging into traffic, or entering parts of the roadway from other parts of the roadway or using a turn signal without consequently conducting such an action within 5 seconds”.
  2. ‘Incorrect turn signal’ shall be defined as the turn signal on the wrong side of the vehicle in respect to what direction the vehicle is making the action or simply the activation of the hazard lights instead of the turn signal.
  3. Bicycles shall be exempt from this law if they are unable to use turn signals and/or hand signals.
  4. Any person charged with Failure to Use Signals shall receive the following punishment: $30-$50 citation.

§ 5.

  1. ‘Hindering’ shall be an illegal infraction in Firestone. Hindering shall be defined as: “going at or less than 20s/s lower than the posted speed limit unless a traffic situation requires it”.
  2. ‘Traffic situation’ shall be defined as preventing a collision or as defined by ‘waiting’.
  3. The Department of Public Works shall be exempt from Hindering while sweeping the street, and are permitted to go as slow as they wish without repercussions.
  4. All vehicles/bicycles that are unable to go fast enough to not count as Hindering shall not be authorized to use the road in question, unless it is a bicycle (which are still limited according to chapter 6 § 3).
  5. Any person charged with Hindering shall receive the following punishment: $10 citation per every 10s/s under the speed limit (example: $30 citation if the person is going 30s/s under the speed limit).
  6. Should the vehicle/bicycle in question be stopped completely (0s/s) or is the speed measurement thereof too difficult due to a rapid change in low and medium speeds, it shall count as (Motorized) Obstruction of Traffic, not Hindering. It shall only count as Hindering and not (Motorized) Obstruction of Traffic when the vehicle/bicycle is not stopped completely. Henceforth, Hindering cannot be a charge alongside (Motorized) Obstruction of Traffic, unless it is in regards to two occurrences (for example, if the vehicle was Hindering for a reasonable time and then stopped completely).

§ 6.

  1. ‘Improper Turn or Lane Change’ shall be an illegal infraction in Firestone. Improper Turn or Lane Change shall be defined as: “turning or switching lanes in an improper manner which could endanger other road users, is in violation of signage or road markings, or is not conducted correctly”.
  2. ‘Conducted correctly’ shall include failure to turn from the appropriate lane (right-hand lane for right turns, left-hand lane for left turns (unless specified differently by road signs/markings)) or any other improper turn or lane change which, to a reasonable person, would be considered improper or dangerous.
  3. ‘Lane change’ in this Act shall be defined as at least half of the vehicle entering a lane which they weren’t in before.
  4. Any person charged with Improper Turn or Lane Change shall receive the following punishment: $50 to $150 citation.

§ 7.

  1. ‘Motorized Obstruction of Traffic’ shall be an illegal infraction in Firestone. Motorized Obstruction of Traffic shall be defined as: “obstructing traffic from moving with a motor vehicle unless a traffic situation requires you to stop or you are legally permitted to stop in such an area”.
  2. ‘Traffic situation requires you to stop’ shall be defined as to avoid a collision or as defined by ‘waiting’.
  3. Any person charged with Motorized Obstruction of Traffic shall receive the following punishment: $100 citation. $200 citation on roads with a speed limit of at or above 70s/s.

§ 8.

  1. Any crimes committed within a work zone have extra punishments. Citations of crimes committed in a work zone are doubled, and arrests of crimes committed in work zones have 100 seconds added onto them. Citations or arrests conducted in danger zones but not committed therein cannot have extra punishments.
  2. A ‘work zone’ shall be defined as an area within 100 studs of any cones, flares, stationary DOT/DPW vehicles with their hazard or amber lights flashing (excluding any buses), DOT/DPW employees at the side of the road outside of their vehicle (while they are conducting road works or other maintenance (on vehicles for example)), or other objects used by workers or on-duty law enforcement officers to control traffic or close areas of work to the public.
  3. Any citable crimes committed by Department of Transportation employees during the operation of a taxi with one or more passengers aboard have extra punishments. Citations of crimes committed are doubled.

§ 9.

  1. ‘Entering an Area not Designated for Vehicles/Bicycles’ shall be an illegal infraction in Firestone. Entering an Area not Designated for Vehicles/Bicycles shall be defined as: “entering any area by bicycle or motor vehicle when such area is not designated for the vehicle/bicycle”.
  2. This charge shall not be used if there is already a charge for it. For example, boarding the median during the conducting of a u-turn is not Entering an Area not Designated for Vehicles/Bicycles, as there is already a charge for it (Making an Illegal U-Turn).
  3. Areas not designated for vehicles/bicycles shall include, but are not limited to:
    a. the curb or central barrier dividing a roadway
    b. the sidewalk (unless a bicycle is riding upon it to find a parking space)
    c. any area where entering for the vehicle/bicycle in question is prohibited. Bike lanes may be entered by motor vehicles for a distance not to exceed 100 studs after yielding to bicycles.
    d. any area where, when entered, may pose an avoidable threat to life or property (without consent)
    e. any grass/dirt patch(es) or offroad area where it is clear vehicles should stay on a paved roadway, unless it is for parking, stopping, or waiting. This shall not apply to bicycles.
  4. Any person charged with Entering an Area not Designated for Vehicles/Bicycles shall receive the following punishment: $50 to $150 citation.
