REVISED NATIONAL GUARD DUTY ACT
PREAMBLE:
To revise and clarify the previously established duties of the Firestone National Guard in the context of the new Version 3.
BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:
SECTION 1: The Firestone National Guard, henceforth referred to as “the National Guard”, shall be considered the primary armed force of the State of Firestone.
a) The National Guard shall be considered a law enforcement agency.
b) Any separate divisions of the National Guard and their duties, including the 1st Military Police Regiment, 3rd Infantry Regiment, 6th Ranger Regiment, 9th Medical Platoon, and any future divisions shall be defined and distinguished internally by the Major General of the National Guard, who is henceforth referred to as “the Major General”.
i) The Major General shall have the authority to create new divisions and reorganize or disband existing ones.
c) The Firestone Coast Guard, henceforth referred to as “the Coast Guard”, shall be considered a child department of the National Guard subject to all laws pertaining to the National Guard and to the authority of the Major General.
i) The Coast Guard shall be considered a law enforcement agency.
ii) The incumbent Governor of the State of Firestone, henceforth referred to as “the Governor”, and the Major General shall have the authority to suspend operations of any divisions, individuals, or the Coast Guard at any time for an indefinite period.
SECTION 2: “Fort Beaumont”, the land and its structures granted to the National Guard in Stapleton County as a base of operations and which shall be henceforth referred to as “the Base”, shall be considered the property of the government of the State of Firestone and a restricted area.
a) The boundaries of the Base shall be considered as the fence holding warning signs designating it as an area belonging to the National Guard, extended to meet and continue two hundred (200) studs into the sea, excluding the fencing closest to the front gate, which shall extend three hundred (300) studs from the nearest fence post, whereupon it shall turn to meet and continue two hundred studs into the sea at a ninety-degree angle.
i) The sections of the boundaries of the Base having been extended into the water shall be connected at the ends to form a contained shape.
b) The area of the Base shall be considered as all land, air, and water, above and below ground, contained within the visible and invisible boundaries already defined.
c) Any and all vehicles, including but not limited to motor vehicles and aquatic vessels, granted to or operated by the National Guard and its members shall be considered a restricted area and henceforth referred to as “Assets”.
d) Any unauthorized persons present within, entering, or attempting to enter Assets or the Base area shall be charged with trespassing, as defined in “A Bill to Repeal and Replace A Bill to Recognize Restricted Areas”.
i) Unauthorized persons shall be defined as any persons not a member of the National Guard lacking the permission of a current member of the National Guard to enter or be present within Assets or the Base.
ii) The Governor and the Major General shall have the authority to grant permanent access to Assets and the Base to individuals at their discretion, whose names shall be made known to the current members of the National Guard.
e) Should any unauthorized persons present on, entering, or attempting to enter Assets or the Base boundaries be deemed a threat to the security and integrity of Assets or the Base or any persons contained within them, members of the National Guard shall have the authority to employ lethal force.
i) No member of the National Guard shall be prosecuted for the termination or attempted termination of any unauthorized persons present on, entering, or attempting to enter any restricted area.
SECTION 3: The Coast Guard shall be considered the primary maritime law enforcement agency of the State of Firestone.
a) The Coast Guard shall have the authority to enforce all laws within its jurisdiction.
b) The jurisdiction of the Coast Guard shall be considered as all waters, ports, docks, and beaches belonging to the State of Firestone.
c) The Coast Guard shall, in addition to the waters, be permitted to patrol or station at all ports, docks, and beaches owned by the State of Firestone.
i) The Coast Guard shall take the shortest lawful route to any destination on land.
d) The Coast Guard shall not enter waters belonging to the Firestone Department of Corrections unless to pursue an individual who has committed a crime.
i) “Waters belonging to the Firestone Department of Corrections” shall be defined as the area of the water extending one hundred and fifty (150) studs in all directions from the prison island.
SECTION 4: The National Guard shall have the authority to enforce all laws within its jurisdiction.
a) When the National Guard, excluding the Coast Guard, is not deployed, its jurisdiction shall be considered as the Base.
i) When not deployed, the National Guard, excluding the Coast Guard, shall not be permitted to leave the Base.
b) The Coast Guard shall be permitted to leave the Base in an aquatic vessel or specially designated motor vehicle to conduct its standard duties.
c) When the National Guard is deployed, its jurisdiction shall be considered as the entire State of Firestone until the deployment has concluded.
SECTION 5: The Governor shall have the authority to deploy the National Guard at any time.
a) In an emergent situation, the Major General shall have the authority to deploy the National Guard for a maximum of twelve (12) hours, during which time the Governor must be notified.
b) The Major General shall have the authority to authorize and conduct training exercises for a duration of no more than one hundred and twenty (120) minutes, during which time the National Guard shall be considered deployed and shall minimize interference with citizens and other departments to the best of its ability.
c) Should it be desired, both the Governor and the Major General shall have the authority to deploy any one (1) constituent division of the National Guard at any time for any duration, not to exceed more than one actively deployed division concurrently, during which time said division shall be considered deployed and its jurisdiction expanded appropriately.
d) The Coast Guard shall be considered constantly deployed to conduct ordinary operations, except when otherwise suspended.
e) During an active State of Emergency or under a Declaration of War, any and all members of the National Guard shall be excused from all official obligations in the State of Firestone until the State of Emergency or war has been legally and officially ended.
SECTION 6: Assistance from the National Guard may be requested by members of any other law enforcement agency for a maximum of three (3) hours, during which time the National Guard shall be considered deployed and its jurisdiction expanded appropriately.
a) Should the emergent situation be resolved before the three-hour maximum, the National Guard shall return to the Base immediately and will no longer be considered deployed.
b) Should the emergent situation not be resolved before the three-hour maximum, the members of the National Guard present shall request an extension from the Governor or the Major General.
i) Should the extension not be granted, the National Guard shall return to the Base immediately and will no longer be considered deployed.
ii) Should the extension be granted, the National Guard shall remain deployed until the emergent situation has been resolved or their deployment is ended by the Governor or the Major General, at which point the National Guard shall return to the Base immediately and will no longer be considered deployed.
c) Members of the Stapleton County Fire Department, should it be deemed necessary, may also request medical assistance from medically qualified members of the National Guard.
i) “Medically qualified” shall be considered as those members of the National Guard holding the appropriate certifications, as determined by the Major General.
SECTION 7: The Governor shall have the authority to delegate tasks and powers granted to an officer or officers of the National Guard deemed proper should the need become apparent.
a) Under emergent circumstances, should the Governor be absent, the Lieutenant Governor of the State of Firestone shall have the authority to wield the powers granted to the Governor in this bill until the Governor should return.
b) Under emergent circumstances, should both the Governor and Lieutenant Governor be absent, the Major General shall have the authority to wield the powers granted to the Governor in this bill until the Governor or Lieutenant Governor should return.
SECTION 8: This legislation shall be enforced by the Governor and the Major General.
SECTION 9: The “National Guard Duty Act” and all its attendant amendments shall be declared null and void.
SECTION 10: This legislation shall go into effect immediately upon passing both chambers and being signed into law by the Governor.
