NATIONAL GUARD DUTY ACT
An Act
to Set the Duties of the National Guard, as well as define its Deployment and Authority

PREAMBLE
To set the duties of the guard; to clear confusion and rewrite regulation.

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:

SECTION 1. The Firestone National Guard shall be considered the primary armed force of the State of Firestone.
(a) Their jurisdiction is set by deployment (see Section 2).
(b) They shall also be considered a Law Enforcement Agency.

SECTION 1A. Deployments:
(a) The Firestone National Guard may be deployed by the Governor of Firestone at any
time for a plausible reason.
(b) The Firestone National Guard, if emergent, may deployed by the Firestone National
Guard Major General for a plausible reason, for no more than twelve (12) hours.
The Governor must be informed, and the Governor may end this deployment if
desired.
(c) The Firestone National Guard Special Forces may be deployed by the Governor of
Firestone at any time for a plausible reason. The Firestone National Guard
Special Forces may also be deployed by the Firestone National Guard Major General
– although the Governor must be informed, and the Governor may end this
deployment if desired.
(d) The Firestone National Guard Coast Guard shall be automatically deployed at all
times, although this may be suspended by the Governor.
(e) Should the Governor be absent, the Lieutenant Governor may assume the role of
Governor within Section 1A(a), 1A(b), 1A(c), and 1A(d), and may perform such
actions.

SECTION 2. Jurisdiction:
(a) Should the Firestone National Guard be deployed, their jurisdiction shall be
statewide – though must follow the orders given by command.
(b) Should the Firestone National Guard not be deployed, their jurisdiction shall be the Town of Greendale. The Firestone National Guard is not permitted to leave the Town of Greendale whatsoever if not deployed – unless called for, in circumstances set within this legislation. However, the Firestone National Guard Coast Guard is permitted to leave the Town of Greendale to take the shortest and lawful route to the area for spawning their vessels in order to enter the water: as such, the Firestone National Guard Coast Guard jurisdiction shall be expanded to include this route and spawning area – and may only use it to spawn their vessels in order to enter the water.
( c ) The Firestone National Guard Coast Guard has a special jurisdiction (see
Section 5A).

SECTION 2A. The Firestone National Guard:
(a) May not;
i. Utilize any vehicle outside of its jurisdiction;
ii. Enforce any laws outside of its jurisdiction, or;
iii. Be armed with any sort of weaponry outside of its jurisdiction.

SECTION 3. Deployments outside the State of Firestone:
(a) Be it a time of war, the Governor of Firestone may deploy the Firestone National
Guard to territory outside of the State of Firestone, should a Declaration of War
have passed Congress authorizing such deployment.
(b) If emergent, the Governor of Firestone may deploy the Firestone National Guard to
a territory outside of the State of Firestone, without a Declaration of War, for
no more than 24 hours with a plausible reason.
(c) Should the Governor be absent, the Lieutenant Governor may assume the role of
Governor within Section 3(a) and 3(b) of this legislation, and may perform such
actions.

SECTION 4. The general abilities and duties the Firestone National Guard may have within Firestone itself are set within Section 4A, B, C, D, and E of this legislation.

SECTION 4A. The Firestone National Guard may be requested by the Department of Homeland Security should appropriate assistance be needed, for a maximum of three (3) hours; as such, their jurisdiction shall be temporarily extended during this time. The Governor of Firestone must be informed this has happened – and may end this deployment at any time.

SECTION 4B. The Firestone National Guard Military Police may only enforce laws on on-duty members of the Firestone National Guard; though is able to detain or arrest any individual who may be interfering in Firestone National Guard operations: be it “Interfering with an Officer”, a charge defined in the legislation “A Bill to Define More Crimes” – and is able to enforce such law.

SECTION 4C. The Firestone National Guard may be requested by any other Law Enforcement Agency when absolutely necessary for an emergent situation, for a maximum of three (3) hours; as such, their jurisdiction shall be temporarily extended during this time. The Governor of Firestone must be informed this has happened – and may end this deployment at any time.

SECTION 4D. The Firestone National Guard may only enforce laws in their jurisdiction, doing so outside of their jurisdiction is forbidden.

SECTION 4E. The Firestone National Guard must follow all lawful orders given by the Governor, otherwise regarded as the Commander-in-Chief of the Firestone National Guard.

SECTION 4F. Further abilities and duties may be provided by other legislation.

SECTION 4G. Should the Governor be absent, the Lieutenant Governor may assume the role of Governor mentioned earlier within this legislation, and thus may perform such actions.

SECTION 5. The Firestone National Guard Coast Guard shall be considered the primary Law Enforcement Agency responsible for the protection of all waters in the State of Firestone.
(a) They have jurisdiction separate thereof the main Firestone National Guard.
(See Section 5A).

SECTION 5A. Jurisdiction of the Firestone National Guard Coast Guard:
(a) The Firestone National Guard Coast Guard shall have jurisdiction over all waters
in Firestone, including the “central lake” within StapIeton County, although;
(b) They may not enter “prison waters” without the reasonable grounds to do so.
i. “reasonable grounds” within Section 5A(b) of this legislation may include,
but is not limited to: to pursue an individual who has committed an illegal
act.
ii. “prison waters” is defined by Section 1(b) of the legislation “A Bill to
Protect Correctional Waters”.

SECTION 5B. As such previously mentioned – per Section 5 and 5(a) – the Firestone National Guard Coast Guard is permitted to enforce all laws within their jurisdiction.

Maritime Crimes”, found here:

(b) They may work with the StapIeton County Fire Department Search & Rescue Division
as well as the Department of Corrections Marine Division.

SECTION 6. The phrase “Should the Governor be absent” within this legislation means: if the Governor has submitted an inactivity notice, making the Lieutenant Governor the Acting Governor; or, if the Governor has committed inactivity for seven days.
“inactivity” and “inactivity notice” are defined by Article VI of the Constitution.

SECTION 7. This legislation shall be overseen by the Governor and enforced by the Governor as well as the rightful members of the Firestone National Guard.

SECTION 8. This legislation shall go into effect immediately.

SECTION 9. All laws in conflict with this legislation shall be declared null and void.
