Racketeering Influenced Corrupt Organizations Act ('RICO')

BE IT ENACTED BY THE CONGRESS HERE ASSEMBLED THAT:

Section 1: The Secretary of the Department of Homeland Security shall have the authority to label organizations and groups as “Criminal Organizations” pursuant to the requirements of this act. Such labeling shall be public information and be publicly announced. It may also be appealed through the District Court as a civil case against the state. Should the court find the labeling does not meet the requirements of this act, the labeling shall be overturned and all penalties under this act rendered null.

Section 1A: for the purposes of this act, an “organization or group” shall be defined as either a Roblox group OR a definitive collection of unique individuals numbering five or more.

Section 1B: For the purposes of this act, a “member” shall be defined as either physically being in the Roblox group should it be a Roblox group, or participating in the goals and actions of the organization.

Section 2: An organization or group may be declared a Criminal Organization by the Secretary of the Department of Homeland Security if, with probably cause as defined by statute, it meets any of the following criteria:

  • The organization or group is clearly dedicated to causing chaos and unlawful disorder to the state and its people.
  • The organization or group is clearly dedicated to acquiring funds and resources for the commission of criminal acts.
  • The organization or group is openly dedicated to armed or violent rebellion against the state.
  • The organization or group is clearly dedicated to unlawfully hindering, obstructing, or denying the rights of the people guaranteed by the Constitution, Bill of Rights, and laws of the State.

Section 3: Once declared a Criminal Organization, said organization shall lose the privilege to maintain or acquire a business license issued by the Department of Commerce. Its members shall lose the privilege to be employed by the state, county, or any municipality. Its members shall lose the privilege to run for public office, and shall be grounds for the impeachment of any impeachable official that resides within the organization. Its members shall lose the privilege to maintain or acquire a Civilian Firearms License. These privileges shall be reinstated should the individual leave and distance themself from the organization.

Section 3A: For the purposes of this act, “distance themself from the organization” shall be defined as refusing to assist or provide benefit to any active member of the organization as it pertains to the execution of the organization’s operations.

Section 4: Chapter 4, §11 shall be added to the criminal code, entitled “§11 - Racketeering”

Section 4A: Subsection (a) of the aforementioned shall state “(a) The act of Racketeering shall be recognized as an unlawful offense in the State of Firestone.”

Section 4B: Subsection (a1) of the aforementioned shall state “(a1) The act of Racketeering shall be defined as committing any criminal offense in the furtherance of the goals, objectives, message, or generally agreed upon course of a labeled Criminal Organization.”

Section 4C: Subsection (b) of the aforementioned shall state “(b) Law enforcement officers acting in their capacity while undercover to undermine a labeled Criminal Organization who must commit a criminal act to be acknowledged in the organization shall be immune to prosecution under this section as long as such was done in good faith.”

Section 4D: Chapter 4, §11 of the criminal code shall be a Class B felony, punishable by 800 seconds in jail and a fine of $950 in game. The fine may be disregarded when it becomes implausible for law enforcement to actually give the fine.

Section 4E: Chapter 4, §11 of the criminal code shall be considered a special circumstances offense, and be uniquely punishable by no less than three hours in prison, and no more than six hours in prison upon conviction in court.

Section 5: This act shall be enforced by the Secretary of Homeland Security, the courts, and all law enforcement agencies with the power to arrest.

Section 6: This act shall go into immediate effect upon going through the Constitutionally required processes to do so and this bill shall be forever regarded as the “Racketeering Influenced Corrupt Organizations Act” (‘RICO’).
