FINANCIAL CONFISCATIONS ACT
TO REDEFINE ACCOUNTABILITY OF FINANCIAL CONFISCATIONS
Proposed by: President pro tempore Automationeer
Be it enacted by the State of Firestone Congress here assembled,
§ 1. TITLE
(a) This Act shall be known as the “Financial Confiscations Act”.
§ 2. ENACTMENT
(a) This Bill shall go into effect as an Act of Congress upon the completion of the constitutionally required processes.
§ 3. SEVERABILITY
(a) Should any part of this Act be stuck down and/or declared unenforceable, then that part shall be severed with the rest remaining in full force and effect unless all is struck down and/or declared unenforceable.
§ 4. ENFORCEMENT
(a) This Act shall be enforced by all Courts and other Judicial Bodies of the State of Firestone.
(b) Any Law Enforcement Officer who acts in violation of Section 8 of this Act shall be seen as unlawfully abusing their office and may subsequently face civil litigation and/or disciplinary action.
(i) Law Enforcement Officers shall be protected wherein they are reasonably unaware that Section 8 of this Act has been violated unless such infringement was the result of gross negligence by said Law Enforcement Officer.
(ii) No arrest or citation issued in violation of Section 8 of this Act shall be viewed as a false arrest or false citation, unless dictated otherwise by existing or newer legislation.
§ 5. DEFINITIONS
(a) For the purposes of this Act, ‘Financial Seizure Accountability Act’ shall be defined as: https://forums.stateoffirestone.com/t/17295
(b) For the purposes of this Act, ‘Citation’ shall be defined as the act of a Law Enforcement Officer (or anyone with the power to arrest defined in legislation) issuing a written order to an individual where the individual is obligated to pay a fine.
(c) For the purposes of this Act, ‘Singular Encounter’ shall be viewed as the moment of time from which a Law Enforcement Officer (and anyone assisting said Law Enforcement Officer) has seen unlawful conduct to action taken as a direct result of such unlawful conduct.
(d) For the purposes of this Act, ‘Arrest’ shall be defined as the act of a Law Enforcement Officer incarcerating an individual.
(e) For the purposes of this Act, the ‘Firestone Criminal Code’, as described by the Criminal Code Revision Act (R), shall be defined as: https://trello.com/b/EGN3OQzQ.
(f) For the purposes of this Act, the ‘Act to Simplify False Arrest and False Citation’ shall be defined as: https://forums.stateoffirestone.com/t/17861.
(g) For the purposes of this Act, the ‘Financial Confiscation’ shall be defined as as any form of citation issued by a Law Enforcement Officer to any individual within the State of Firestone.
§ 6. REPEALMENTS
(a) The Financial Seizure Accountability Act shall be repealed in its entirety and declared null and void.
§ 7. AMENDMENTS
(a) Chapter 4, Section 11 (Racketeering) of the Firestone Criminal Code shall be amended to remove the Citation value.
(b) Chapter 4, Section 12 (Aviation Violation) of the Firestone Criminal Code shall be amended to remove the Citation value.
(c) Chapter 5, Section 2 (Criminal Misuse of a Firearm) of the Firestone Criminal Code shall be amended to remove the Citation value.
(d) Chapter 1, Section 4 (Failure to Comply) of the Firestone Criminal Code shall be amended to add a Citation value of $500.
(e) Chapter 2, Section 6 (Assault) of the Firestone Criminal Code shall be amended to add a Citation value of $750.
(f) Chapter 2, Section 8 (Battery) of the Firestone Criminal Code shall be amended to add a Citation value of $900.
(g) Section 7b of An Act to Simplify False Arrest and False Citation shall be amended.
(i) Section 7b of An Act to Simplify False Arrest and False Citation currently states: “Citation shall be defined as the act of a Law Enforcement Officer (or anyone with the power to arrest defined in legislation) issuing a written order to an individual for a traffic violation where the individual is obligated to pay a fine.”
(ii) Section 7b of An Act to Simplify False Arrest and False Citation shall be amended to state: “Citation shall be defined as the act of a Law Enforcement Officer (or anyone with the power to arrest defined in legislation) issuing a written order to an individual where the individual is obligated to pay a fine.”
§ 8. FINANCIAL SEIZURE
(a) No individual shall be subjected to a Financial Confiscation greater than FSD $1,000 in a Singular Encounter.
(b) No individual shall be subjected to a Citation and an Arrest for the same offence(s) in a Singular Encounter.
