An Act to Protect Our Line of Succession

Be it enacted by the State of Firestone Congress here brought together and assembled that;

In a time where crime is rampant and our government officials are frequently targeted by criminals, the Firestone Congress finds it necessary to ratify this statute- henceforth referred to as An Act to Protect Our Line of Succession, or in short, ‘this Act’ or ‘this Statute’.

ARTCLE 1 - PROTECTION MANDATES

SECTION 1: The Firestone Department of Homeland Security (“DHS”) shall be required to protect all officials described by the Gubernatorial Succession Act to standards that are reasonable considering their proximity to the governorship.

SECTION 1A: DHS shall also be tasked with the protection of appointed and elected government officials or officers that are not recognized in the Gubernatorial Succession Act, however they shall have complete discretion over how this protection is issued, if at all.

SECTION 1A: DHS may suspend or revoke any of the above official’s protections for reasons they find plausible.

SECTION 1B: These officials may be forcibly transported away or into a location for their safety by DHS without any agent or officer involved being charged with any crime that would be in conflict with this section. These officials may also be followed and trailed by DHS without DHS facing any legal repercussions. However, should the official state they are declining protection, DHS shall not be protected by this Section until such a time that the protection is requested again.

SECTION 2: The main priority of protection shall be the Governor, Lieutenant Governor, and the Speaker of the House- all titled “Key Officials” for the purpose of this Act.

SECTION 2A: Key Officials may be forcibly transported away or into a location for their safety by DHS without any agent or officer involved being charged with any crime that would be in conflict with this section. Key Officials may also be followed and trailed by DHS without DHS facing any legal repercussions. Key Officials may not have their protection suspended or revoked unless the official themselves (as they may be lawfully entitled to by other statute) orders their or another’s protection be suspended or revoked.

SECTION 2B: The Governor may alter the list of “Key Officials” at their discretion, however any new “Key Official” must be on the Gubernatorial Line of Succession (as described by the Gubernatorial Succession Act).

SECTION 4: Any official who has their protection by DHS suspended or revoked must be notified of this suspension or revocation. DHS shall be required to provide reason, however shall not be required to disclose evidence or names of sources if they so choose not to.

ARTICLE 2 - PROTECTION OPERATIONS

SECTION 1: Should any official assigned protection in accordance of Article 1 of this Act (who is present in the Gubernatorial Succession Act) be in a public area, DHS shall reserve the right to ‘lock down’ property thus restricting access to the property within these parameters;
a) The property being locked down is only being locked down to reasonably protect the official
b) The property being locked down is not majorly inhibiting the travel of the public
c) The property being locked down remains in this status for as little time as possible

SECTION 1A: DHS shall reserve the right to request citizens consent to a search before entering property that is locked down. DHS may not force any citizen to consent to a search, however may deny them entry if they do not consent to a search. DHS shall reserve the right to deny any citizen with a weapon (legal or illegal) into an area that is locked down. For all intents and purposes, a government official being present on such property shall be an ‘emergency’ as described by Article 5 of the Constitution.

SECTION 1B: DHS is mandated to be conservative when using this power and shall be expected to employ this power only when absolutely necessary.

SECTION 1C: Only the most Senior on duty (highest ranking or lowest callsign relative to 0) Agent from the Secret Service may invoke this power. Other on duty law enforcement may be restricted from entering the property by the most Senior Agent without the Agent committing a crime when this power is invoked.

SECTION 1D: This power may not be invoked on private property without the consent of the owner of the property.

SECTION 2: DHS may violate any and all traffic laws without penalty in the name of protecting an official in an emergent situation where;
a) There is a low chance of any citizen being injured because of traffic laws not being respected
b) There is a direct and immediate threat to an official being protected where using ELS or driving on conventional roads would greatly exacerbate the threat

SECTION 2A: Only the most senior on duty (highest ranking or lowest callsign relative to 0) agent from the Secret Service may invoke this power.

ARTICLE 3 - EXECUTION

SECTION 1: This Act shall go into effect upon completing the Constitutionally mandated procedures.

SECTION 2: Should any Article, Section, phrase, word, or letter of this Act be declared unconstitutional, the rest shall not remain in effect.
