A Resolution to Establish Floor Rules and Motions

Preamble: As vested by the district charter, the presiding officer has the ability to establish and modify floor rules.


BE IT ENACTED BY THE DISTRICT OF PROMINENCE COUNCIL HERE ASSEMBLED THAT,

SECTION 1. Nullifications and Definitions

The existing floor rules here, shall be deemed null and void.

“A Resolution to Establish Council Motions” defined here, shall be deemed null and void.

“A Resolution to Fix the Motion to Call the Council” defined here, shall be deemed null and void

“A Bill to Revise Motion Majority Requirements” defined here, shall be deemed null and void.

“Presiding Officer” shall be defined as the individual who is presiding over the session, but is limited to either the Chairperson, Deputy Mayor, or Mayor.

“Member of Council” shall be defined as any individual elected into the Prominence District Council.

“Simple Majority Vote, Simple Majority” shall be defined as a (½) or 50% vote by the District Council.

“Super Majority Vote, Super Majority” shall be defined as a (⅘) or 80% vote by the District Council.

“Unanimous Vote” shall be defined as a (5/5) or 100% vote by the District Council.

SECTION 2. Session Motions

Section 2A.

Session Motions shall be hereby be established and enforced.

Section 2B.

“Session Motions” shall be defined as any request for specific action, as defined by the specific motion request which are listed and defined in Section 2C. These motions shall be voted on by members of the council, and executed by the presiding officer of the session.

“Seconds” shall be defined as when a member of the council wishes to see such session motions take effect within a session. A valid second shall be defined as when a member of the council states “Second” to a valid motion defined in Section 2C.

Section 2C.

The following session motions are to be considered valid motions to be used by members of the council:

  • Motion to Debate
  • Motion to Table a Legislative Piece
  • Motion to Remove a Legislative Piece from the Table
  • Motion to Call the Previous Question (PQ)
  • Motion to Recess the Session
  • Motion to Amend Legislation
  • Motion to Reconsider a Vote
  • Motion to Eject
  • Motion to Close Chamber Doors
  • Motion to Open Chamber Doors
  • Motion to Adjourn the Council

Section 2D.

The session motions listed in Section 2C shall be defined as the following:

Section 2D(a). Motion to Debate

(a1) Requires a simple majority vote (½ or 50%) to pass and requires a sufficient second to be voted on.

(a2) Opens the floor to debate on legislation, this can only be motioned during the reading of a legislation.

Section 2D(b). Motion to Table a Legislative Piece

(b1) Requires a super majority vote (⅘ or 80%) to pass and requires a sufficient second to be voted on.

(b2) Suspends the consideration of a legislative piece and sets it onto a seperate “Tabled” docket.

Section 2D(c). Motion to Remove a Legislative Piece from the Table

(c1) Requires a super majority vote (⅘ or 80%) to pass and requires a sufficient second to be voted on.

(c2) Places a legislative piece on the “Table” docket onto the session docket and allows for consideration of the legislative piece.

Section 2D(e). Motion to Call the Previous Question

(e1) Requires a simple majority vote (½ or 50%) to pass and requires a sufficient second to be voted on.

(e2) Ends debate on the legislation and moves to voting.

Section 2D(f). Motion to Recess the Session

(f1) Requires a unanimous vote (5/5 or 100%) to pass and requires a sufficient second to be voted on.

(f2) Ends all session proceedings for a specified amount of time, the session shall commence upon the ending of the specified amount of time.

Section 2D(g). Motion to Amend Legislation

(g1) Requires a super majority vote (⅘ or 80%) to pass and requires a sufficient second to be voted on.

(g2) Modifies a bill being considered. While presenting the motion, the individual presenting it shall read what the legislative piece being considered currently states aswell as what it will be amended to state.

Section 2D(h). Motion to Reconsider a Vote

(h1) Requires a super majority vote (⅘ or 80%) to pass and requires a sufficient second to be voted on.

(h2) Redo a vote on a previously completed in the ongoing session.

Section 2D(i). Motion to Eject

(i1) Requires a unanimous vote (5/5 or 100%) to pass, this does not require a sufficient second to be voted on.

(i2) Removes an individual from the chamber, must be presented with valid reasoning.

Section 2D(j). Motion to Close Chamber Doors

(j1) Requires a unanimous vote (5/5 or 100%) to pass and requires a sufficient second to be voted on.

(j2) Closes the chambers from the public.

Section 2D(k). Motion to Open Chamber Doors

(k1) Requires a unanimous vote (5/5 or 100%) to pass and requires a sufficient second to be voted on.

(k2) Opens the chambers to the public, this can only be motioned if a motion to close chamber doors passes.

Section 2D(l). Motion to Adjourn Council

(l1) Requires a super majority vote (⅘ or 80%) to pass and requires a sufficient second to he voted on.

(l2) Ends the session.

Section 2E. Permissions to make motions

Any member of the council has the authority to make a session as long as it meets the requirements stated.

SECTION 3. Session Requests

Section 3A.

A sessional request shall be defined as any point of action a member of the council, not voted on by the council, for the presiding officer to execute.

Section 3B

The following sessional requests are deemed to be valid points presented by a member of council:

  • Point of Personal Privilege
  • Point of Clarification
  • Point of Information
  • Point of Order

Section 3C

The sessional requests listed in Section 3B shall be defined as the following:

Section 3C(a). Point of Personal Privilege

(a1) Allows the presenting member of council to make a formal request to the chamber.

Section 3C(b). Point of Clarification

(b1) Allows the presenting member of council to present a fact about the legislative piece actively being considered.

**Section 3C(c). Point of Information

(c1) Allows the presenting member of council to ask a question about the legislation piece to the chief sponsor.

Section 3C(d). Point of Order

(d1) Allows the presenting member of council to query whether or not the sessional procedure is being followed.

Section 3D. Permissions to Make Sessional Requests

Any member of council has the authority to make a session request to the chanber.

Section 4. Presiding Officer’s Authority

Section 4A.

The Presiding Officer shall have the ability to set a limit for debate time of no less than 12 hours and no greater than 24 hours. This ability shall be null if the proposal in consideration is a nomination confirmation, a charter ratification, or any other good cause deemed by the presiding officer.

Section 4B

The Presiding Officer has the ability to not require a vote on any of the following motions:

  • Motion to Call the Previous Question
  • Motion to Adjourn Council
  • Motion to Debate

Section 4C

The presiding officer has the ability to adjourn the session themselves as long as there is no legislative pieces still on the active docket to be considered.

Section 5. Process of Voting

Section 5A.

The process of voting shall be executed by the presiding officer of the session and shall be followed in the following sequence:

  • The legislation is presented by the presiding officer
  • Members of the council are given time to read the legislation
  • The floor is opened by the presiding officer or is motioned by a member of council
  • The floor remains open until a motion to call the previous question is presented and passed
  • The voting period is opened for a set time greater than 12 hours, but must be closed upon every member of council placing their vote OR may be closed once the majority vote requirements are met
  • The presiding officer announces the votes on the legislation at hand and whether passes or fails the process of voting

Section 5B.

Any legislation not voted in this manner is to be deemed null and void.

SECTION 6.

This District Ordinance shall go into effect immediately upon passing the legal processes as described by the District Charter.
