Authority to Arrest Act of 2022

Mr. urdadcaleb (for himself, Mr. BlueLineEnforcement, Mr. L_3ee, Mr. Clonemep, Mr. crankyIuke and Mr. 1superchris2) proposed the following bill:


A BILL

To establish departments with the authority to arrest; to include new departments and their authority to arrest in their respective version; to modernize standing law regarding such.

Be it enacted by the Senate and the House of Representatives of the State of Firestone in Congress assembled,

§1. Title
(a) This Act shall be known, and may be cited as, the “Authority to Arrest Act of 2022”.

§2. Enactment
(a) This Act shall go into effect upon the completion of the constitutionally required processes.

§3. Severability
(a) Should any part of this Act be struck down and/or declared unenforceable, then that part shall be severed with the rest remaining in full force and effect unless all is struck down and/or declared unenforceable.

§4. Enforcement
(a) This Act shall be enforced by any relevant parties.

§5. Definitions
(a) The “Authority to Arrest Act” shall be defined as this.

(b) The phrase “version 2 Map of Stapleton County” shall be in reference to this map.

(c) The phrase “version 3 Map of Stapleton County” shall be in reference to this map.

(d) The phrase “certified law enforcement officer” shall be defined as an individual who has been certified by the Firestone Peace Officer Standards and Training Academy to execute the duties of a law enforcement officer.

§6. Repealments
(a) The Authority to Arrest Act shall be repealed in its entirety and declared null and void.

§7. Amendments
(a) This Act makes no amendments.


§8. Regarding the Authority to Arrest
(a) Only those designated by state law may be permitted to conduct arrests, detain individuals, conduct search and seizure, or issue fines and citations.

   (i) Actions taken in violation of this section shall be regarded as false and unlawful and may be overturned by a court. Violators may also be subject to Impersonation.

   (ii) The Firestone Peace Officer Standards and Training academy may revoke certifications of individuals who violate this Act.

(b) This Act shall not prohibit or limit any other entity, as long as such is detailed with other law or legislation, from enforcing that law or legislation. However, such enforcement may not be in violation of the guidelines outlined in subsection (a).

(c) Only certified law enforcement officers (alongside members of the National Guard) of the following departments shall be legally able to conduct arrests, detain individuals, conduct search and seizure, or issue fines and citations:

   (i) Firestone State Patrol;

   (ii) Firestone Bureau of Investigation;

   (iii) Firestone Department of Homeland Security, but only when operating within the version 2 Map of Stapleton County;

   (iv) Firestone National Guard;

   (v) Firestone Department of Corrections;

   (vi) Firestone Park Service, but only when operating within the version 3 Map of Stapleton County;

   (vii) Stapleton County Sheriff’s Office;

   (viii) Stapleton County Port Authority, but only when operating within the version 3 Map of Stapleton County;

   (ix) Redwood Police Department, but only when operating within the version 3 Map of Stapleton County;

   (x) Arborfield Police Department, but only when operating within the version 3 Map of Stapleton County;

   (xi) Prominence District Police, but only when operating within the version 3 Map of Stapleton County.

(d) No certified law enforcement officer who is “suspended” or otherwise temporarily barred from executing their duties shall be able to conduct the procedures outlined within subsection (a) of this Section whilst representing the department that issued the suspension or temporary bar.
