An Act to Establish the Firestone Bureau of Investigation

AN ACT
to Establish the Firestone Bureau of Investigation

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:

SECTION 1. ESTABLISHMENT

(a) The Firestone Bureau of Investigation shall be established; and they shall have the duty of investigating major occurrences of importance within the State of Firestone, combating corruption at all levels of government, and to work together with other governmental entities to overall safeguard the state; they are an agency tasked with the enforcement of the law through appropriate investigations and other such measures, and as such, are a law enforcement agency.

(b) The Firestone Bureau of Investigation shall be managed by a Director. The Director of the Firestone Bureau of Investigation must be nominated by the Governor, and pass a confirmation (with a simple-majority) by the Senate; the Director may only be removed from the position by the will of the Governor, or by impeachment. Should there be no incumbent Director of the Firestone Bureau of Investigation, the Governor may designate an individual to be the Acting Director, who shall assume all authority the Director of the Firestone Bureau of Investigation has; the Acting Director is to serve until a legitimate Director is confirmed by the Senate.

(c) The Firestone Bureau of Investigation shall be under the Executive Branch of Firestone; as such, the Governor shall have the ability to take forth administrative actions towards and within the Firestone Bureau of Investigation, and may set policy and regulation that must be followed through the appropriate means to do so, such as by Executive Order(s) and/or Memorandum(s).

(d) The Department of Justice shall be considered the parent agency of the Firestone Department of Investigation; however, only the Attorney General is permitted to supervise the Firestone Bureau of Investigation on behalf of the Department of Justice. The Attorney General shall only be permitted to supervise the Firestone Bureau of Investigation to an extent at the full discretion of the Governor; the Attorney General cannot manage and/or run the Firestone Bureau of Investigation nor hire or remove the Director or any other member of it.

SECTION 2. AUTHORITY AND RESPONSIBILITIES

(a) The Firestone Bureau of Investigation shall have the ability to open investigations on any official, of government or of otherwise importance, should it be suspected or confirmed, with reasonable grounds or more, that the official of government or otherwise importance in question has committed a crime, has taken part in corrupt, illegal, or illicit activities, accepted bribes, etc.

(b) The Firestone Bureau of Investigation shall have the ability to conduct reasonable surveillance, under the bounds of the law, should it be suspected or confirmed, that the individual under surveillance, has committed a serious crime, or, may be a threat towards the security of the State of Firestone.

(c) The Firestone Bureau of Investigation shall have the ability to open investigations, take appropriate action, and do absolutely whatever necessary, under the law, in order to ensure the security of the State of Firestone; be it through an investigation of any event prominent within the State of Firestone, investigate major scandals; or through any other measure, at the full discretion of the Governor.

(d) The Firestone Bureau of Investigation shall have the ability, under special circumstances, conduct operations within foreign territory, with the purpose of safeguarding the security of the State of Firestone; be it at the full discretion of the Governor, and with the considered advice of the Department of State.

(e) The Firestone Bureau of Investigation shall have the general responsibility to provide beneficial information to other law enforcement agencies and entities, when possible, in order to apprehend possible criminals.

SECTION 3. POLICY AND REGULATION

(a) Before any investigation, surveillance, or any other measure or operation is taken by the Firestone Bureau of Investigation, including but not limited to those mentioned within Section 2(a), (b), (c), (d), and 2(e) of this act, it must receive the direct advice and consent of the Governor to begin; and the Governor have the ability to order an investigation, surveillance, or other such measure or operation be redone or re-investigated should it be deemed not done properly by the Governor; and so shall the Governor have the ability to order an investigation or operation of some sort be done. However, investigations fully on the Governor instead require the advice and consent of the Lieutenant Governor and Attorney General.

(b) The Director of the Firestone Bureau of Investigation shall be responsible for the organization of appropriate general policy and regulation for the Firestone Bureau of Investigation, though is recommended but not obligated under any means to take the advice of the Attorney General; and so shall the Director have the responsibility to ensure the policy and regulation of the Firestone Bureau of Investigation be enforced.

(c) As set by Section 1(c) of this act, the Governor shall have the ability to take administrative actions towards and within the Firestone Bureau of Investigation, and may set policy and regulation that must be followed.

SECTION 4. STAFFING

(a) All employment positions, within the Firestone Bureau of Investigation, shall be considered “primary” employment jobs; although certain aiding positions may be set as “secondary” employment jobs, at the discretion of the Director.

(b) The Firestone Bureau of Investigation is obligated to ensure all employees of it are to the best possible standard, with vetting, training, and measures to the point to ensure the prevention of classified information being given to unauthorized entities.

(c) The Firestone Bureau of Investigation must ensure that the leakage of classified and/or otherwise sensitive material, especially if its leakage poses a threat to the security of the State of Firestone, be certain terms for removal for the individual in the agency leaking the information.

SECTION 5. This legislation shall be overseen by the Governor and enforced by the Firestone Bureau of Investigation.

SECTION 6. This legislation shall go into effect immediately.

SECTION 7. All laws in conflict with this legislation are hereby declared null and void.
