A Bill to Redefine Evasion and Establish Resisting Arrest

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:

Section 1: This legislation shall take the currently recognized crime of evasion; repeal and replace it with this legislation, and redefine its corresponding definition of that said crime. The crime of resisting arrest shall also be established within this legislation which will consist of punishments that will stated in later sections within this legislation.

Section 1A: ‘A Bill to Recognize Evasion as a Crime” (A Bill to Recognize Evasion as a Crime) shall hereby be declared null and void.

Section 2: Evasion shall be defined as: (The act of using any sort of vehicle to get flee the scene of a crime you have committed when being confronted by law enforcement personnel of that said crime). Fleeing from a law enforcement officer that is attempting to confront you of a crime you’ve committed shall count as evasion. Fleeing a law enforcement conducting any sort of a stop on you who has probable cause (an officer knowing that an individual has committed a crime since that he or she saw it be committed or by having received sufficient evidence of the crime an individual committed. All arrests conducted by law enforcement officers shall require probable cause) of you committing a crime shall count as evasion. If an individual is confronted by a law enforcement officer who does not have probable cause of that individual committing a crime, then that said individual will not be considered as “evading” if he/she chooses to leave the scene of the confrontation.

Section 2A: The crime of evasion shall be considered to be a felony should it be committed. Any individual who commits the crime of evasion shall receive prison time that shall be no less than three-hundred seconds to no more than five-hundred seconds in prison.

Section 2B: Any individual who commits the crime of evasion may be prosecuted in the Firestone Courts. It shall be the duties of the Firestone Courts (Court Justice+) to oversee all cases related to evasion. Any citizen, law enforcement officer, etc, wishing to prosecute another individual for evasion shall need to file for a criminal litigation.

Section 2C: Resisting Arrest shall be defined as: (The act of fleeing or avoiding/preventing a law enforcement officer from conducting an arrest on an individual who has committed a crime). It shall count as resisting arrest if an individual flees a law enforcement officer on foot who is confronting that said individual of a crime they committed and who is attempting to conduct an arrest on the said individual for the crime they committed. It shall also count as resisting arrest if an individual makes an attempt to avoid/prevent a law enforcement officer from conducting an arrest on that said individual.

Section 2D: The crime of resisting arrest shall be considered to be a misdemeanor should it be committed. Any individual who commits the crime of resisting arrest shall receive prison time that shall be no less than two-hundred seconds to no more than three-hundred seconds in prison.

Section 2E: Any individual who commits the crime of resisting arrest may be prosecuted in the Firestone Courts. It shall be the duties of the Firestone Courts (Court Justice+) to oversee all cases related to resisting arrest . Any citizen, law enforcement officer, etc, wishing to prosecute another individual for resisting arrest shall need to file for a criminal litigation.

Section 3: It shall be the duties of the Firestone State Patrol, Stapleton County Sheriff’s Office, Department of Homeland Security, Department of Corrections, and Firestone Courts (Court Justice+) to enforce this piece of legislation.

Section 4: This legislation shall go into effect immediately upon passing.

Section 5: All laws in conflict with this legislation are hereby declared null and void.
