A Bill To Combine and Add Correctional Laws V2
BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:
SECTION 1: The following crimes shall hereby be recognized: “Jailbreak”, “Attempted Jailbreak”, “Possessing Illegal Contraband”, “Assisting a Jailbreak” and “Failure to Follow Correctional Staff inside a Correctional Facility”. Committing any of these crimes shall be illegal.
SECTION 2: The crime “Jailbreak” shall be defined as: The act of successfully escaping the Firestone State Penitentiary as an Inmate while in custody by getting past the main gate and/or inner walls of the Penitentiary.
SECTION 2A: The crime “Jailbreak” shall be considered a felony. A subject that commits this crime shall serve a Prison sentence of 800-900 seconds. A subject that commits the crime “Jailbreak” may be prosecuted in the Firestone Courts. Should a subject be prosecuted in the Firestone Courts, the Firestone Courts may issue a Prison sentence of no more than 12 hours to a subject that has been found guilty of “Jailbreak”.
SECTION 2B: All Law Enforcement Agencies shall have permission to use lethal force against subjects that commit the crime of “Jailbreak”.
SECTION 3: The crime “Attempted Jailbreak” shall be defined as: The act of attempting to escape the Firestone State Penitentiary as an Inmate while in custody by performing any action within the walls of the Firestone State Penitentiary that could lead to a successful escape.
SECTION 3A: The crime “Attempted Jailbreak” shall be considered a felony. A subject that commits this crime shall serve a Prison sentence of 600-800 seconds. A subject that commits the crime “Attempted Jailbreak” may be prosecuted in the Firestone Courts. Should a subject be prosecuted in the Firestone Courts, the Firestone Courts may issue a Prison sentence of no more than 8 hours to a subject that has been found guilty of “Attempted Jailbreak”.
SECTION 3B: All Law Enforcement Agencies shall have permission to use lethal force against subjects that commit the crime of “Attempted Jailbreak”.
SECTION 4: The crime “Possessing Illegal Contraband” shall be defined as: The act of having tools on one’s person that can be used to escape the Prison or harm Correctional Staff in any way, including, but not limited to, keys, spoons, crowbars, drills, shovels, firearms, knives, shanks and self-made or improvised weaponry, while inside the Firestone State Penitentiary.
SECTION 4A: The crime “Possessing Illegal Contraband” shall be considered a felony. A subject that commits this crime shall serve a Prison sentence of 500-650 seconds. A subject that commits the crime “Possessing Illegal Contraband” may be prosecuted in the Firestone Courts. Should a subject be prosecuted in the Firestone Courts, the Firestone Courts may issue a Prison sentence of no more than 5 and a half hours to a subject that has been found guilty of “Possessing Illegal Contraband”.
SECTION 4B: Any food products distributed by the Department of Corrections to Inmates or civilians shall not count as illegal contraband. Any items distributed by the Department of Corrections to Inmates or civilians shall not count as illegal contraband if those items are kept inside of the same room they were distributed in, or if the subject holding these items has clear permission from a member of Correctional Staff to enter another room with those items. The Department Head of the Department of Corrections shall be allowed to create a policy to further clarify in which room what distributed items are allowed to be possessed, however, this policy may not go against anything established in this legislation. If this policy states that a certain item can be held in a certain room, that shall count as clear permission from Correctional Staff to enter that room with the item specified in this policy.
SECTION 4C: Legally obtained firearms shall not count as illegal contraband, provided that the owner of the legal firearm lets Correctional Staff confiscate the firearm upon entry of the Firestone State Penitentiary. If the owner of the legal firearm refuses to give up their legal firearm while inside the Firestone State Penitentiary, they may be charged with the crime “Possessing Illegal Contraband”. Correctional Staff shall be responsible for removing legal firearms and thus a subject may not be charged with this crime if Correctional Staff has not searched the subject and/or asked the subject if they possess any legal firearms upon their entry of the Firestone State Penitentiary. Subjects may also not be charged with this crime if their legal firearm has been confiscated from them. Correctional Staff must give any confiscated legal firearms back to their owner, when that owner leaves the Firestone State Penitentiary.
SECTION 4D: Correctional Staff shall have the right to search Inmates inside of the Correctional Facility for any illegal contraband. Correctional Staff shall also have the right to search any civilians who enter or leave the Firestone State Penitentiary for any illegal contraband. Additionally, Correctional Staff shall have the right to search any room inside of the Firestone State Penitentiary.
SECTION 4E: If an Inmate inside the Firestone State Penitentiary has tools on their person that can be used to escape, they may also be charged with the crime “Attempted Jailbreak”, which is defined in section 3-3B of this legislation. If a civilian inside the Firestone State Penitentiary has tools on their person that can be used to escape, they may also be charged with the crime “Assisting a Jailbreak”, which is defined in section 5-5C of this legislation.
SECTION 4F: Any illegal contraband found may be confiscated by Law Enforcement Agencies.
SECTION 4G: Any tools Law Enforcement Officers possess shall not be counted as illegal contraband and they shall be exempt from this crime.
SECTION 5: The crime “Assisting a Jailbreak” shall be defined as: The act of assisting an Inmate in custody to escape or attempt to escape the Firestone State Penitentiary by for example, but not limited to, providing an Inmate with transport, providing an Inmate with intelligence to help them to escape, or entering the Firestone State Penitentiary to get to an Inmate with the intention of helping them escape.
SECTION 5A: The crime “Assisting a Jailbreak” shall be considered a felony. A subject that commits this crime shall serve a Prison sentence of 500-750 seconds. Any individual who commits the crime “Assisting a Jailbreak” may be prosecuted in the Firestone Courts. Should a subject be prosecuted in the Firestone Courts, the Firestone Courts may issue a Prison sentence of no more than 7 hours to a subject that has been found guilty of “Assisting a Jailbreak”.
SECTION 5B: All Law Enforcement Agencies shall have permission to use lethal force against subjects that commit the crime of “Assisting a Jailbreak”, if an Inmate who is escaping or attempting to escape is in the direct vicinity (at most 8 studs) of the subject that is committing this crime.
SECTION 5C: Correctional Staff shall not be charged with the crime “Assisting a Jailbreak” if they are escorting an Inmate from one room to another inside of the Firestone State Penitentiary or if they are letting an Inmate stay in a room inside the Correctional Facility. However, they shall be charged with this crime if they intentionally let an Inmate out of the Firestone State Penitentiary; if they intentionally supply an Inmate with illegal contraband, as defined in Section 4-4G of this Bill, with the intention of helping the Inmate escape or attempt to escape; or if they intentionally give an Inmate access to illegal contraband, as defined in Section 4-4G of this Bill, with the intention of helping the Inmate escape or attempt to escape. Correctional Staff shall also be exempt from this crime if there is a dire emergency occurring that would lead to evacuation, such as a fire inside the Firestone State Penitentiary or any other event that could, without an evacuation, cause major bodily harm or death to more than half of the Inmates and/or civilians inside of the Firestone State Penitentiary. Inmates may however not be removed from their cells during such a dire emergency if they are safe inside their cells. Additionally, if Inmates are evacuated from the Firestone State Penitentiary, they must be guarded and kept in custody by Correctional Staff to prevent the Inmates from escaping custody.
SECTION 6: The crime “Failure to Follow Correctional Staff inside a Correctional Facility” shall be defined as: The act of, while being instructed to follow Correctional Staff, intentionally not following Correctional Staff inside the Firestone State Penitentiary while having permission to enter the Firestone State Penitentiary.
SECTION 6A: The crime “Failure to Follow Correctional Staff inside a Correctional Facility” shall be considered a misdemeanor. A subject that commits this crime shall serve a Prison sentence of 200-400 seconds. Any individual who commits the crime “Failure to Follow Correctional Staff inside a Correctional Facility” may be prosecuted in the Firestone Courts. Should a subject be prosecuted in the Firestone Courts, the Firestone Courts may issue a Prison sentence of no more than 1 hour to a subject that has been found guilty of “Failure to Follow Correctional Staff inside a Correctional Facility”.
SECTION 7: The term “Correctional Staff” within this Bill shall be defined as a member of the Firestone Department of Corrections, with the rank of Correctional Officer or higher, who is on duty.

SECTION 8: All Law Enforcement Agencies with the power to arrest, the Firestone Department of Justice and the Firestone Courts shall be responsible for the enforcement of this legislation.
SECTION 9: The following laws are hereby declared null and void: A Bill to Define Attempted Jailbreak (A Bill to Define Attempted Jailbreak), and Section 2M of A Bill to Recognize More Crimes (A Bill to Recognize More Crimes).
SECTION 10: This legislation shall go into effect immediately after passing Congress and being signed by the Governor.
