A Bill to Combat Ineffective Law Enforcement

BE IT ENACTED BY THIS CONGRESS HERE ASSEMBLED THAT:

Preamble: With a decrease in quality of our law enforcement, even to the point of several officers violating our laws or constitution, this act seeks to ensure the welfare of the public.

Section 1: The courts shall be able to issue Court Orders pursuant to C.III.XIV for the revocation of POST Certifications in the matters described below.

Section 2: Should a law enforcement officer be convicted of any felony, their POST Certification shall be revoked.

Section 3: Should a law enforcement officer be convicted of two misdemeanors, be it one occurrence with two counts or two occurrences with one or more counts, their POST Certification may be revoked at the discretion of the judge.

Section 4: Should a law enforcement officer be convicted of false arrest, their POST Certification may be revoked at the discretion of a judge.

Section 5: Should a law enforcement officer be convicted of violating the rights prescribed to citizens under the constitution, their POST Certification shall be revoked.

Section 6: All actions regarding revocation shall be subject to the appellate process defined in Article Three of the Constitution.

Section 7: The Department of Justice, Courts, and Peace Officer Standards and Training shall be tasked with enforcing this act.

Section 8: This act shall go into effect upon passage by both houses of Congress, and being signed into law by the Governor (or by veto override).
