Thievery Act of 2022

Mr. ADMIRAL_RICKY (for himself and Mr. cityuser) introduced the following amendment:


A BILL

To criminalize the theft of services and theft by false pretenses, and appropriately define crimes of thievery, including extortion.


         Be it enacted by the Senate and House of Representatives of the State of Firestone in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the “Thievery Act of 2022”.


SEC 2. ENACTMENT.

    This Bill shall go into effect as an Act of Congress upon the completion of the constitutionally required processes.


SEC 3. SEVERABILITY.

    Should any part of this Act be struck down and/or declared unenforceable, then that part shall be severed with the rest remaining in full force and effect unless all is struck down and/or declared unenforceable.


SEC 4. ENFORCEMENT.

    This Act shall be implemented by the Manager of the Criminal Code and enforced by all Law Enforcement Officers and Courts of the State of Firestone.


SEC 5. DEFINITIONS.

    For the purposes of this Act, the ‘Firestone Criminal Code’, as described by the Criminal Code Revision Act (R), shall be defined as: https://trello.com/b/EGN3OQzQ


SEC 6. REPEALMENTS.

    Chapter 3, section 7, subsection b of the Firestone Criminal Code shall be repealed.


SEC 7. THEFT.

    (a) Chapter 3, section 2, of the Firestone Criminal Code shall be amended.

         (i) Chapter 3, section 2, subsection a1 of the Firestone Criminal Code currently states:

“Theft shall be the act of physically taking property of another without the consent of the owner.”

         (ii) Chapter 3, section 2, subsection a1 of the Firestone Criminal Code shall be amended to state:

“Theft shall be the act of intentionally taking money, property, or services from a person or entity without the consent of the owner or using deception, but without using force or the threat of immediate force.

         (iii) Chapter 3, section 2, subsection a2 of the Firestone Criminal Code shall be established and state:

“If an act is recognized as unlawful by Chapter 3, Section 6 of this Code, it shall be considered that offense, and not the act of theft as defined in this section.”


SEC. 8. ROBBERY.

    (a) Chapter 2, section 10, subsection a1 of the Firestone Criminal Code shall be amended.

         (i) Chapter 2, section 10, subsection a1 of the Firestone Criminal Code currently states:

“Robbery shall be the act of stealing from a player, business recognized by the Firestone Department of Commerce or other institution recognized by legislation, utilizing fear or force to execute such offense without an object capable of causing severe harm to a player.”

         (ii) Chapter 2, section 10, subsection a1 of the Firestone Criminal Code shall be amended to state:

“Robbery shall be the act of taking money or property from a person or entity using force or the threat of immediate force, without using an object capable of causing severe harm to a person.”


SEC. 9. ARMED ROBBERY.

    (a) Chapter 2, section 11, subsection a1 of the Firestone Criminal Code shall be amended.

         (i) Chapter 2, section 11, subsection a1 of the Firestone Criminal Code currently states:

“Armed robbery shall be the act of stealing from a player, business recognized by the Firestone Department of Commerce or other institution recognized by legislation, utilizing an object capable of causing severe harm to a player and fear or force to execute such offense.”

         (ii) Chapter 2, section 11, subsection a1 of the Firestone Criminal Code shall be amended to state:

“Armed robbery shall be the act of taking money or property from a person or entity using force or the threat of immediate force, while using an object capable of causing severe harm to a person.”


SEC. 10. EXTORTION.

    (a) Chapter 4, section 2, subsection a1 of the Firestone Criminal Code shall be amended.

         (i) Chapter 4, section 2, subsection a1 of the Firestone Criminal Code currently states:

“Extortion shall be the act of using fear of actual force, implied force, to acquire substantive property, currency, or anything of reasonable value, or to pressure a person of authority via fear or force into not properly conducting their duties as prescribed by ethical and legal standards, for the reasonable gain of the perpetrator.”

         (ii) Chapter 4, section 2, subsection a1 of the Firestone Criminal Code shall be amended to state:

“Extortion shall be the act of threatening to accuse someone of a crime or instilling in someone the fear of force in order to coerce them into giving the perpetrator something of reasonable of value, including services, or to compel an employee of the State of Firestone to do or neglect to do an official duty or task.


SEC. 11. GRAND THEFT AUTO.

    (a) Chapter 3, section 6, subsection a1 of the Firestone Criminal Code shall be amended.

         (i) Chapter 3, section 6, subsection a1 of the Firestone Criminal Code currently states:

“Grand theft auto shall be the act of taking another’s vehicle without the consent of the owner. Grand theft auto shall also be the act of entering another’s vehicle without consent- however, if the driver is in the vehicle, he/she must instruct the subject to exit before they may be charged with grand theft auto.”

         (ii) Chapter 3, section 6, subsection a1 of the Firestone Criminal Code shall be amended to state:

“Grand theft auto shall be the act of taking a vehicle without the consent of the owner or through deception, with malicious intent.”

    (b) Chapter 3, section 10 of the Firestone Criminal Code shall be amended.

         (i) Chapter 3, section 10 of the Firestone Criminal Code shall now be titled “§10 - Trespassing on Private Property”.

         (ii) Chapter 3, section 10 of the Firestone Criminal Code shall be amended to state:

"(a) The act of trespassing on private property shall be recognized as a criminal offense within the State of Firestone.

(b) The act of trespassing on private property shall be the act of entering a private establishment or private land in which an individual is not allowed to enter via a written statement, list or anything similar that states that a certain individual is unallowed to enter which is made by the owner of said area or by a physical boundary that is meant to keep unwanted individuals from entering.

(b1) Any individual who refuses to leave a private establishment, private land, or a vehicle after being told to do so by the owner or any individual given permission by the owner to dictate access shall also be considered as this offense.

(b2) A private establishment shall be recognized as a business recognized by the Department of Commerce and the physical commercial area granted to them by the Department of Commerce.

(b3) Private land shall be recognized as any physical area of land bought legally by an individual by use of in-game mechanics.

(c) Any law enforcement officer performing their duties in an official capacity or any other individual acting with a lawful excuse or whom bears the lawful authority to be on the area shall be exempt from this offense."


SEC 12. INSTRUCTIONS TO THE MANAGER OF THE CRIMINAL CODE.

    (a) The use of bold formatting in this Act only emphasises changes made for the convenience of the reader and the Manager of the Criminal Code is instructed to implement these changes without bold formatting.

    (b) The Manager of the Criminal Code is instructed to insert a space between the characters ‘6’ and ‘-’ characters in the title of the card for chapter 3, section 6 of the Firestone Criminal Code.
