So I was thinking about the state of the Supreme Court and thought about what would happen if we only had one CCJ or AJSC. Ultimately that one person would have a whole branch to themselves and could single handedly in theory have all of the courts power. This is concerning to me as a citizen as less and less people go towards being judges and maturing to Supreme Court Justices.
I was just wondering what others thought about this and if any changes need to be made in order to prevent a one sided branch of government. There are pros and cons to having a quorum for the court to do business. So feel free to discuss.
I personally don’t think Danny or Jef would screw over the government but imagine if we had someone in office who wasn’t doing illegal things, so congress couldn’t impeach them, but instead just having a one sided point of view in which one person could remove a law by themselves.
It’s really the best of two evils. Because you can’t really just say: “one judge, shut down the court or let it be overruled.” Because then the Governor, Congress, cops, etc. can do whatever the fuck they want regardless of the Constitution and the rights of the people. And looking over the hundreds of SC cases, impeachments, etc., I think we can gauge that between the likeliness of the judiciary unlawfully fucking you over, and literally any other government body, the judiciary still stands as a significantly less chance of doing so. The only time in judicial history I can think of when things got spoty was Patchy’s incompetence, but he was a DCJ and got yeeted pretty quickly.
The pros of having a quorum would help prevent this, https://trello.com/c/QLVdASj5 . This is a lose lose for the court. If Danny accepts this and finds Jef not guilty then it would show that Danny is biased and did it because it was his friend ( I know I can’t assume but if there was another justice it would be harder to say this as two people with two different morals would have to agree. He would also be in violation of Rule 11 of the GRP). BUT if he does not accept the appeal then Danny has single handily secured a whole branch to himself which was one the worst I described above. A one sided branch with lots of power in one person.
I suggest for a AJSC be nominated as soon as possible to help prevent the above from happening.
Once again I just want to stress that Danny and Jef are two great people. They wouldn’t hurt our government. This is just a scenario that occurs when you have limited justices. Please comment below. Maybe I am missing something. I want to hear your opinion.
RULE 11 - Judicial Recusal
a) No judge may be a witness or party to a matter that they are presiding over.
b) A judge shall recuse him/herself from any matter in which:
i) There is a conflict of interest;
ii) Or other good cause.
c) A judge shall not preside over a matter which involves a department, agency, or other business entity in which him/herself is currently employed or in which they (the judge) has not been separated from for more than three months time.
d) When a judge recuses him/herself they shall note such and the reason for the recusal in the same manner that the plea is entered by the complaint.
e) After a judge has recused him/herself from a matter he/she shall not hear the matter as a judge at any time forward.
f) A recusal may be taken back should it be found that no conflict of interest or other good cause exist otherwise it may not be taken back.
g) A judge shall not hear and rule on a case in an inferior court and then hear and rule upon the same case a superior case.
Yeah I’m kinda fucked no matter what I do here. I can promise you Jef and I aren’t friends, at all. It’s a rare day we don’t get into a derogatory-filled piss fight. And I will of course remain unbiased. But yeah, the public perception ain’t great kids. If I grant the appeal, I look biased and the court loses legitimacy. If I don’t, well I have way too much power. So actually, thinking about it now, I’m just gonna put that one off till I get a new AJSC.
Now, the problem that occurs here is that the person most competent for AJSC is my only fucking DCJ. The Judicial Mentorship Program will be out today, but that will take a few weeks to produce a judge.
