Public Sector Identification Act of 2022

Mr. CITYUSER (for himself, Ms. AUTOMATIONEER, Mr. JACKFRUITISM, and Mr. CLONEMEP) introduced the following bill:


A BILL

To require that public employees identify themselves.


         Be it enacted by the Senate and House of Representatives of the State of Firestone in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the “Public Sector Identification Act of 2022”.


SEC. 2. ENACTMENT.

    This Bill shall go into effect as an Act of Congress upon the completion of the constitutionally required processes.


SEC. 3. SEVERABILITY.

    Should any part of this Act be struck down and/or declared unenforceable, then that part shall be severed with the rest remaining in full force and effect unless all is struck down and/or declared unenforceable.


SEC. 4. ENFORCEMENT.

    This Act shall be enforced by all appropriate bodies including the Courts of the State of Firestone.


SEC. 5. DEFINITIONS.

    (a) For the purposes of this Act, the ‘Show Name mechanic’ refers to the literal game mechanic within Stapleton County that permits a user to display their full Roblox username above their character’s head to all physically close users while the feature is enabled.


SEC. 6. PUBLIC SECTOR IDENTIFICATION.

    (a) Any person on a governmental (i.e. not business nor civilian) ‘team’ within Stapleton County shall be required to, unless exempt by subsection (b), display their username via the Show Name mechanic.

    (b) The following circumstances shall apply for ‘exemption’ from subsection (a) as enumerated—

         (i) On-duty members of the Firestone Bureau of Investigation in any capacity;

         (ii) On-duty members of the Firestone National Guard while undertaking an official deployment or callout under state law;

         (iii) On-duty members of the Department of Homeland Security or Firestone National Guard facilitating protective duties to state government officials or representatives of foreign entities as recognised by the Department of State.

         (iv) On-duty members of the Department of Homeland Security Crisis Response Team or Stapleton County Sheriff’s Office Special Weapons and Tactics Team undertaking official tactical operations as defined by and authorised by the appropriate Commanding Officer.

    (c) A person who fails to obey this Section shall, notwithstanding statute on what grounds an employee may be disciplined for, be subject to disciplinary action no less than a written warning for accidental offences and no less than a strike or equivalent for intentional or repeated offences.

    (d) Department Heads shall be responsible for ensuring that departmental members are appropriately disciplined where violations of this Section occur. A department may be liable to lawsuit from any concerned citizen should there be an improper handling of violations of this Section.

    (e) A Department Head may be reasonably subject to impeachment or removal for improperly handling violations of this Section. It shall be grounds for impeachment to knowingly permit, enable, or mishandle violations of this Section.


SEC. 7. NAME AND BADGE.

    (a) While on-duty, Law Enforcement Officers shall be obligated to provide their full Roblox username and actively used callsign in clear, plain English without equivocation within three minutes of a member of the public physically visible to the Officer stating, also in plain and clear English, a request for the Law Enforcement Officer’s name and badge (or reasonably similar alternative).

    (b) Law Enforcement Officers may delay temporarily providing their identification if they are handling a reasonably serious matter wherein providing their identification could seriously curtail their ability to execute their duties, enforce the law, or preserve life. The Law Enforcement Officer must provide their identification once this curtailment is no-longer active.

    (c) Law Enforcement Officers may not attempt to impede the access to their identification upon request or actively prevent somebody from being able to make a lawful request for identification, such as through using the whisper command or verbosity that would obstruct the reading of their identification.

    (d) Law Enforcement Officers shall be exempt from this Section if they are displaying their name using the Show Name mechanic when their identification is requested.

    (e) Law Enforcement Officers need not obey a request for identification if they have already provided their identification to the person requesting it within the past fifteen minutes.

    (f) Should a Law Enforcement Officer fail to obey such a request, they may be subject to disciplinary action notwithstanding statute on what grounds an employee may be disciplined for, and shall be liable to civil action by the person who made the request for identification if said person was a citizen of the State of Firestone at the point of their request.
