Either CONGRESS has to fix this law of negligant homicide or the COURTS have to fix their COMMON SENCE YOU DON’T CHARGE SOMEONE FOR NEGLIGANT HOMCIDE FOR KILLING WITH PEPPER SPRAY
SECTION 2c: Negligent Homicide shall be defined as: the ending of another life by someone else with no premeditation or malicious intent, however due to not proper precautions (breaking a law) by the suspect resulted in the death of someone.

So according to this law negligant homicide is causing the death of someone due to not proper precautions.
If you look at the meaning of precaution it means a measure taken in advance to prevent something. I don’t think it is a public employee’s, or a officer’s fault that they didnt take the "proper precautions to not kill someone with pepper spray. I think it is the developers fault by not taking the proper precautions to lower or remove damage from pepper spray. So either the courts sue the developers or NOBODY because a officer or a public employee with a pepper spray cant take precautions on pepper spray.
