Extreme Weather Precautions Act

EXTREME WEATHER PRECAUTIONS ACT

Proposed by: Right Honourable Lieutenant Governor Ash1835

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:

SECTION I: This Act shall go into effect as an Act of Congress upon the completion of the constitutionally required processes.

SECTION II: Should any part of this Act be stuck down and/or declared unenforceable, then that part shall be severed with the rest remaining in full force and effect unless all is struck down and/or declared unenforceable.

SECTION III: This Act shall be implemented by the Manager of the Criminal Code and enforced by all Law Enforcement Officers and Courts of the State of Firestone.

SECTION IV; INDIVIDUAL PROTECTIONS

SECTION IV-A: For the purposes of this Act—

SECTION IV-B: In the event of tornadic weather that is present in Stapleton County, individuals within Firestone shall be exempt from certain offences in the Firestone Traffic Code.

SECTION IV-C: Tornadic weather shall be defined as; a severe unexpected climate event that produces strong winds, hail and tornado(s).

SECTION IV-D: These exemptions may only be bestowed if an individual is in immediate danger, injury or death caused by tornadic weather and, “Tornado Sirens”, within Stapleton County are actively in use and producing an audible warning in the respective vicinity.

SECTION IV-E: Tornado Sirens are audible sirens played throughout Stapleton County to provide an emergency warning to the population that tornadic weather is approaching or occurring. SECTION IV-F: Temporary exemptions shall be as outlined in the Firestone Traffic Code, Chapter 9 Section 6. given to the following statutes in the Firestone Traffic Code to all individuals in immediate danger to act in a reasonable manner caused by tornadic weather.

SECTION IV-H: Individuals are no longer exempt from these statutes when not in immediate danger of tornadic weather and an audible tornado siren can no longer be heard.

SECTION V; STAPLETON COUNTY WEATHER SERVICE

SECTION V-A: Individuals employed by the Stapleton County Weather Service or abbreviated as “SCWS” shall be entitled to the same exemptions in Section IV-F.

SECTION V-B: The same criteria outlined in Section IV-D shall be present for the SCWS.

SECTION V-C.1: Individuals in SCWS who hold the rank of “Meteorologist” or higher shall be entitled to the following exemptions to the Firestone Criminal Code (chronologically)

-Chapter 3; Section 10 - Trespassing on Private Property

-Chapter 7; Section 1 - Reckless Boating

SECTION V-C.2: Chapter 7, Section I of the Firestone Criminal Code shall be amended.

SECTION V-C.2a: Chapter 7, Section I of the Firestone Criminal Code currently states:
“(a) Reckless Boating shall be recognized as an unlawful criminal offense in the State of Firestone.

(a1) Reckless Boating shall be the act of, through clear and extreme disregard for others safety, operating a watercraft in a way that creates an undue hazard to another. This includes, but is not limited to; maneuvering the watercraft unsafely or hazardously in a crowded area, maneuvering a watercraft unsafely and hazardous within the area marked in pink here, driving a watercraft onto or against a shore-line with people at an unsafe distance to the watercraft, and operating the watercraft unreasonably close and dangerous to another watercraft.

(a2) The Firestone Coast Guard, Stapleton County Fire Department Search and Rescue, and Firestone Department of Corrections Marine Division shall be exempt from Chapter 7, Section 1 if their warning lights are turned on.

(a3) An operator of a Watercraft shall be exempt from Chapter 7, Section 1 if a part of an approved event by the Department of Boating and Waterways administration and the Department of Boating and Waterways has made strenuous efforts to organize such event in advance and has taken precautions to ensure a safe and blocked off area from the public in which the event shall only be permitted to be within.”

SECTION V-C.2b: Chapter 7, Section I of the Firestone Criminal Code shall now state:

“(a) Reckless Boating shall be recognized as an unlawful criminal offense in the State of Firestone.

(a1) Reckless Boating shall be the act of, through clear and extreme disregard for others safety, operating a watercraft in a way that creates an undue hazard to another. This includes, but is not limited to; maneuvering the watercraft unsafely or hazardously in a crowded area, maneuvering a watercraft unsafely and hazardous within the area marked in pink here, driving a watercraft onto or against a shore-line with people at an unsafe distance to the watercraft, and operating the watercraft unreasonably close and dangerous to another watercraft.

(a4) An operator of a Watercraft shall be exempt from Chapter 7, Section 1 if they hold the rank of Meteorologist or higher in the Stapleton County Weather Service and tornadic weather is present in Stapleton County and tornado sirens are audible near a body of water.”

SECTION V-E: SCWS is no longer exempt from these offences when no longer in immediate danger of tornadic weather and an audible tornado siren can no longer be heard.
