Community Service Act

Be it enacted by the State of Firestone Congress here assembled,

§ 1. TITLE

     (a) This Act shall be known as, and may be cited as, the “Community Service Act”.

§ 2. ENACTMENT

     (a) This Bill shall go into effect as an Act of Congress upon the completion of the constitutionally required processes.

§ 3. SEVERABILITY

     (a) Should any part of this Act be stuck down and/or declared unenforceable, then that part shall be severed with the rest remaining in full force and effect unless all is struck down and/or declared unenforceable.

§ 4. DEFINITIONS AND ESTABLISHMENTS

     (a) For the purposes of this Act, the ‘Firestone Criminal Code’, as described by the Criminal Code Revision Act (R), shall be defined as: Trello

     (b) The Firestone Department of Corrections (from hereon out, ‘FDOC’) shall be defined as The Firestone Department of Corrections

     (c) The Firestone Department of Public Works shall be defined as The Firestone Department of Public Works

     (d) Community Service shall be defined as performing Public Works duties (such as washing cars or buildings, cleaning up trash, volunteering at events, doing maintenance, etc) under the supervision of certified Department of Public Works representatives for an allotted period of time.

     (e) The Community Service Program (from hereon out, ‘the program’ or ‘this program’) shall be established.

     (f) This program may carry out community service to an individual for the following reasons:

          (i) The person has been ordered by the courts as a sentence or part of one.

          (ii) The person has signed a non-prosecution agreement or deferred prosecution agreement with the Department of Justice that includes community service

          (iii) The person has been required to do community service under the Criminal Rehabilitation Act.

     (g) Any person subject to community service shall not be required to do more than 3 hours total.

     (h) All community service done must be logged in a publicly viewable and up-to-date location with evidence of the person starting and completing the community service.

     (i) The Firestone Courts may make their own regulations on when and how to issue community service under the program.

§ 5. COMMUNITY SERVICE WHILE SERVING A SENTENCE IN PRISON

     (a) Section 5 of this act shall only apply when the person being subject to community service is in a state correctional facility.

     (b) The Warden of the Department of Corrections and the Secretary of Public Works (from hereon out, the ‘Warden’ or the ‘Secretary’) shall be responsible for setting guidelines and policies under which this program shall be managed (including requirements for operating the program) - particularly from a safety, security, and logistical perspective. The Warden and Secretary must maintain a publicly viewable and up-to-date representation of these guidelines.

     (c) Before departing from or returning to a correctional facility, all inmates are to be searched to ensure that they are not in possession of any illegal or dangerous items.

     (d) With authorization from both the Warden (or any appropriate designee thereof) and the Secretary of Public Works (or any appropriate designee thereof), inmates may be lawfully transported from a correctional facility to any area - for the purposes of completing community service - so long as the requirements outlined by Section 5 of this Act are met.

     (e) In the events that the requirements outlined by Section 5 of this Act cease to be met - or the relevant pol, all inmates must be immediately transported back to an appropriate correctional facility.

     (f) All inmates must remain under constant supervision of no less than two on-duty Firestone Department of Corrections employees. The Warden may - as outlined by Section 5(b) of this Act - extend this requirement.

     (g) All Law Enforcement Officers shall be authorized to detain and search any inmate - outside of a correctional facility under the parameters of this act - at any time.

     (h) Should an inmate refuse to follow appropriate instructions, they are to be detained until such a time that they may be returned to an appropriate correctional facility.

     (i) Should an inmate attempt to escape or otherwise flee from FDOC employees or any other Law Enforcement Officer, they may be arrested pursuant to the Firestone Criminal Code.

     (j) Should an inmate - intentionally or otherwise - prevent or attempt to prevent their transportation to or from community service (under this program), they may be arrested for Failure to Comply.

     (k) Community service may not begin if:

          (i) If there is an active prison alarm or jailbreak.

          (ii) If there is an active lockdown as defined by FDOC Policy.

          (iii) If the Governor of the State of Firestone has declared a state of emergency, as defined by the State of Firestone Constitution.

§ 6. COMMUNITY SERVICE WHILE OUTSIDE OF PRISON

     (a) Section 6 of this act shall only apply when the person being subject to community service is not in a state correctional facility.

     (b) The Secretary of Public Works (from hereon out, the ‘Secretary’) shall be responsible for setting guidelines and policies under which this program shall be managed (including requirements for operating the program) - particularly from a safety, security, and logistical perspective. The Secretary must maintain a publicly viewable and up-to-date representation of these guidelines.
