An Emergency Amendment to Fix Variable Sentencing Ranges & Classes
Be it enacted by the Senate and House of Representatives of the State of Firestone in Congress assembled,
SECTION 1 - DEFINITIONS
(a) The “Criminal Code Revision Act (R)” shall be defined as “Criminal Code Revision Act (R)”.
SECTION 2 - SEVERABILITY & ENACTMENT
(a) Should any part of this act be struck down and/or declared unenforceable, then that part shall be severed with the rest remaining in full force and effect unless all is struck down and/or declared unenforceable.
(b) Upon the completion of the constitutionally required processes, this Act shall enter into effect immediately.
SECTION 3 - AMENDMENTS
(a) Section IE2 of the Criminal Code Revision Act (R) currently states: “Special factors that increase or decrease specific sentences may be included on each respective offense, and thus any sentence for the charge shall not be restricted by section IE1 of this legislation, given a substitute range or sentence is provided. Charges that can be used in an arrest may be stacked, per each charge. Should a game mechanic exist that restricts the punishment of crimes (meaning that if your crime total exceeds a number set by the game), subjects shall not be subject to the charge of Overcharging, or any offense of that nature. Each charge, sentenced, may also be stacked. Should a charge ‘stack’ exceed the Constitutional limit, it shall be maxed out at the limit.”
(b) Section IE2 of the Criminal Code Revision Act (R) shall be amended to state: “Special factors that increase or decrease specific sentences, or classes of offenses may be included on each respective offense, and thus any sentence for the charge shall not be restricted by section IE1 of this legislation, given a substitute range or sentence is provided, and the “CLASS” Custom Field may be removed, and/or replaced with specific guidelines included on each respective offense. Charges that can be used in an arrest may be stacked, per each charge. Should a game mechanic exist that restricts the punishment of crimes (meaning that if your crime total exceeds a number set by the game), subjects shall not be subject to the charge of Overcharging, or any offense of that nature. Each charge, sentenced, may also be stacked. Should a charge ‘stack’ exceed the Constitutional limit, it shall be maxed out at the limit.”
(c) Section IG1 of the Criminal Code Revision Act (R) currently states: “The “Class” custom field shall be the Class of the offense, as prescribed by section IE of this legislation.”
(d) Section IG1 of the Criminal Code Revision Act (R) shall be amended to state: “The “Class” custom field shall be the Class of the offense, as prescribed by section IE of this legislation, unless the class is altered in accordance with IE2 of this legislation.”
(e) Section IG2 of the Criminal Code Revision Act (R) currently states: “The “Jail Time” custom field shall be the amount of time peace officers may arrest a subject, for the respective offense, in-game.”
(f) Section IG2 of the Criminal Code Revision Act (R) shall be amended to state: “The “Jail Time” custom field shall be the amount of time peace officers may arrest a subject, for the respective offense, in-game, unless the jail-time or sentence is altered in accordance with IE2 of this legislation.”
(g) Section IF2 of the Criminal Code Revision Act (R) shall be created, and shall state: "A “DOCTRINE” label on an offense shall dictate that the Section is a doctrine, not a criminal offense.
