An Act to Protect Arrestees

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT


SECTION I: An ‘Arrestee’, by this legislative piece, shall be defined as: an individual currently being officially placed under arrest by someone with the legal authority to do so.

SECTION II: ‘False Arrest’ shall be defined as: A Bill to Fix False Arrest - #2

SECTION III: Section 2 of false arrest currently states:

  • “False Arrest shall be defined as the act of a law enforcement officer arresting an individual for an offense that isn’t unlawful, the wrong offense, or for arresting an individual for an offense they clearly didn’t commit.”

SECTION IV: Section 2 of false arrest shall have the following included within this specific section:

  • "False arrest can also be accounted for when one engages an arrest on someone with probable cause that has been already utilized, which means that they already have been arrested with that particular probable cause and redoing such shall be similar to ‘double jeopardy’."

SECTION V: Therefore, the same probable cause cannot be re-used once the subject (arrestee) has completed his incarceration within the state’s penitentiary. Such shall be suable with the grounds of false arrest within the court of law.

SECTION VI: This legislation shall be enforced by the State of Firestone courts collectively.

SECTION VII: This legislation, upon passage within both chambers and met with the signature of the incumbent State of Firestone Governor, shall take immediate effect.
