AN ACT

To define the act of rioting as a criminal offense, and to constitute a punishment for such action.

SECTION 1A

The act of “riot starting” shall be declared illegal. In the event if such action is performed, it shall be considered a felony.

SECTION 1B
The act of “rioting” shall be declared illegal. In the event if such action is performed, it may be considered as both a felony or misdemeanor, as defined in Section 1C.

SECTION 1C

In order to decide if the act of “rioting” is a misdemeanor or a felony, this section shall define characteristics of rioting.

  • Rioting shall be considered a felony if:
  1. The individual(s) who performed rioting is armed or soliciting criminal activity, or
  2. The individual(s) who performed rioting is committing criminal actions that are considered felonies under their correlating legislation, or
  3. The individual(s) who performed rioting has harmed another individual whilst rioting, or
  4. The individual(s) who performed rioting has obstructed the duties of public / law enforcement employees, or
  5. The individual(s) who performed rioting has failed to cease the act of rioting after being lawfully warned to disperse,
  • Rioting shall be considered a misdemeanor if:
  1. The individual(s) who performed rioting is committing criminal actions that are considered misdemeanors under their correlating legislation.

SECTION 2A

A “riot” shall be defined as; “the combination of two or more people unlawfully using force or violence of which jeopardizes public safety, tranquility, or order.”

SECTION 2B

“Riot starting” shall be defined as; “the act of conspiring with others to incite, cause, or produce a riot, or directing / soliciting other persons to participate in a riot to acts of force or violence” The act of riot starting shall lead to a minimum of 150 seconds to a maximum of 750 seconds of incarceration.

SECTION 2C
“Rioting” shall be defined as; “the act of participating in the act of rioting, of which uses unlawful force or violence that jeopardizes public safety, tranquility, or order.” The act of rioting shall lead to a minimum of 150 seconds to a maximum of 650 seconds of incarceration.

SECTION 2D

This section shall define miscellaneous terms that may be confusing to some.

  • Public / Law Enforcement employees shall be defined as individuals which have a membership in the following groups (which are clearly defined in other laws within the state);

    • Firestone State Patrol
    • Stapleton County Sheriff’s Office
    • Firestone Department of Homeland Security
    • Firestone National Guard
    • Stapleton County Fire Department
    • Firestone Department of Transportation
    • Firestone Department of Public Works
  • Public disturbance shall be defined as disorderly conduct, also defined verbatim in this legislation:

SECTION 2E: The act of being “lawfully warned to disperse” shall be defined as; “being told by a law enforcement officer to leave or cease certain actions as defined by the officer theirself.”

SECTION 3

This legislation shall be enforced by the State of Firestone law enforcement, or any government entity that has the ability to arrest. (Firestone State Patrol, Stapleton County Sheriff’s Office, Department of Homeland Security, Firestone National Guard)

SECTION 4

This legislation shall be implemented immediately upon passage of both chambers.

SECTION 5

In the event that a law contradicts this legislation upon passage, it shall be nullified by the chambers via presenting new legislation.
