A House Resolution to Establish the House Committee on Oversight and Accountability


IN THE HOUSE OF REPRESENTATIVES OF THE STATE OF FIRESTONE

DECEMBER 13th, 2024



§1. TITLE

(a) This resolution may be cited as “A House Resolution to Establish the House Committee on Oversight and Accountability”.


§2. ESTABLISHMENT AND ADDITIONAL PROVISIONS

(a) The House Committee on Oversight and Accountability, or the House Oversight and Accountability Committee(HOAC), shall hereby be established by this chamber of Congress who shall presently have the responsibility of: ensuring the efficiency, effectiveness, and accountability of the state government and all its agencies. This committee shall provide a check and balance on the role and power of the state government and a voice to the people it serves.

(b) The House Committee on Oversight and Accountability shall be a standing committee composed of five (5) representatives who shall, in turn, elect one (1) representative who shall serve as the chairman. The inaugural chairman shall be Speaker Pro Tempore MattSixtyNin. Members may be recalled by resolutions proposed by members in the House of Representatives. The Chairman shall hold no special powers except to preside and be the overseer. The inaugural members of the committee shall be: Speaker Pro Tempore MattSixtyNin (inaugural chairman), Representative MichaeiCalabrese, Representative CODE_4SENDTHENEXT, Representative T_xom, and Representative DeltaTrigger.

(c) The House Committee on Oversight and Accountability, subsequently after conducting business, may submit an official recommendation to the House of Representatives.

(d) The House Committee on Oversight and Accountability shall be authorized to summon individuals to testify before them, as well as request the Department of Justice to file charges for any violations of Chapter 6, Section 2 of the Firestone Criminal Code as defined here

(e) The House Committee on Oversight and Accountability may, by unanimous vote, establish committee bylaws and rules of procedure of which all members shall adhere to or face immediate recall (removal) from the committee by the House of Representatives.

(f) The House Committee on Oversight and Accountability shall incorporate a system to track all matters within the committee which shall additionally be made available to the public.

(g) The House Committee on Oversight and Accountability, with a majority vote of all committee members, shall have the ability to subpoena any individual relevant to the committee’s purpose to appear before the committee.

(h) If the vote to subpoena passes with a majority, a subpoenaed individual must be sent a letter giving the location and time of questioning. This letter shall be made public. Reasonable efforts must be made to contact the requested individual to inform them of their subpoena to appear. The individual must be given at least seven days to comply with the subpoena.

(i) The committee, with a majority vote of all committee members, shall have the ability to subpoena any information relevant to the committee’s purpose.

(j) In the event any of the information being subpoenaed is classified, the committee must have a valid belief that more likely than not the information is related to the impeachment inquiry. If the individual, department, or organization in possession of the classified information refuses to voluntarily turn over the information and declassify it, then the committee must receive written verification from a judge or justice of the State of Firestone affirming that there is a valid belief that the information being requested is more likely than not related to the impeachment inquiry. If the committee receives this written verification, then the individual, department, or organization subpoenaed to provide the information must provide the entire committee the information in a closed setting. The committee members and individual providing the information shall be exempt from any civil or criminal liability for providing and being in possession of this information. The committee members shall not share the classified information publicly or to non-committee members, except with the individual who provided the information, else be punished by relevant law. Any attempt to subpoena classified information must also be approved by the Speaker of the House, or the Speaker Pro Tempore in the absense or vacancy of the Speaker of the House.

(k) Upon approval of the committee (with the simple majority vote noted above), a letter requesting subpoenaed information must be sent to the official responsible for that information giving instructions on who to send the information to. This letter shall be made public. If the official who sent the request is not able to fulfill that request, they must notify the sender. Reasonable efforts must be made to contact this official to inform them of the subpoena for information.

(l) Individuals being questioned by the committee shall be sworn to an oath of honesty in which they acknowledge that providing testimony that they believe to be false to the committee is prohibited. Violation of this oath shall be considered perjury and punished as set by relevant law.

(m) The House Committee on Oversight and Accountability shall be considered a standing committee under the authority of the Impeachment Inquiry Act which shall remain indefinitely until this House Resolution is nullified, this committee shall be automatically renewed every 29 days.


§3. EFFECTIVE DATE

(a) Upon passing the State of Firestone House of Representatives, this shall immediately go into effect.
