A Bill to Redefine Consensual Encounters and Detainments

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:

PREAMBLE: The current definitions of these terms have been deemed vague and poorly worded to the point of needing to be reworked. This legislation aims to achieve that goal.

SECTION 1[a]. “A Bill to Define Consensual Encounters and Detainments” is hereby declared null and void.

SECTION 1[b]. “A Bill to Define Consensual Encounters and Detainments” shall be defined as the following:

SECTION 2. A “consensual encounter” shall be defined as any interaction between on-duty law enforcement and a pedestrian in which the law enforcement officer has no reasonable suspicion nor probable cause to stop the pedestrian with. The pedestrian may leave the consensual encounter at any time, and any attempt by the law enforcement officer to detain or otherwise force the pedestrian to speak with them without reasonable suspicion or probable cause shall be considered unlawful detainment.

SECTION 3. A “detainment” shall be defined as restricting someone from leaving when stopped by an officer unless permitted by the officer to do so. In order to detain someone, an officer must have either reasonable suspicion or probable cause.

SECTION 4. “Reasonable suspicion” shall be defined as the plausible belief that a crime has been, is being, or will be committed by a subject.

SECTION 5. “Probable cause” shall be defined as knowing that someone has committed, is committing, or will commit a crime based on facts and evidence. Any and all arrests made and citations issued by law enforcement shall require probable cause.

SECTION 6. This legislation shall be enforced by all law enforcement personnel as well as the court system and Department of Justice. The Firestone Peace Officer Standards and Training academy shall be responsible for teaching the terms defined in Sections 2, 3, 4, and 5 of this legislation to their cadets.

SECTION 7. This legislation shall go into effect immediately upon passage.
