A Bill to Establish the Firestone Department of Defense

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:

Section 1. Establishment

(a) The Firestone Department of Defense shall hereby be established.

(b) The Firestone Department of Defense shall hereby be recognized as an official department of the State of Firestone; and shall serve under the Executive Branch.

(c) The Firestone Department of Defense shall be recognized as a secondary department.

(d) The Firestone Department of Defense shall be led by a Secretary, a cabinet-level position that reports directly to the Governor. The Secretary must be nominated by the Governor, and pass a Senate confirmation with a simple-majority by the Senate; the Secretary may be dismissed by the Governor at any given time for any reason deemed plausible by the Governor or may be removed through the process of impeachment, as stated in the Constitution.

(e) The Firestone Department of Defense shall be defined as the following group:

Section 2. Responsibilities & Duties

(a) The Firestone Department of Defense shall be responsible for coordinating and overseeing all functions of the government directly related to state security and war, providing an oversight and investigative service for all armed forces, provide legal services for armed forces, have the ability to establish task forces for counter-terrorism, have the authority to implement directives and policies directed to the armed forces. They shall also be responsible for maintaining and informing the public of the current defense condition of the state, as well as advising the Governor on matters of state defense, security, and war.

(b) The Department of Defense shall have the authority to launch investigations into armed forces personnel should they be; reported, suspected of committing crime, violate any directive or policy set by the Department of Defense, or be found in violation of any policy or standard operating procedure set by the head of the Firestone National Guard. The Department of Defense may report any investigative findings to the military court and/or a higher entity in the chain of command for due process or the rendering of punishment. The military court and/or higher entity in the chain of command is not obligated to heed said findings unless otherwise directed by the Governor or directed by law. The Department of Defense shall not have the authority to override decisions made by the military court. Nor shall they have the authority to override decisions made by the commanding staff of armed forces unless the orders are unreasonable, found in violation of law, or otherwise directed by the Governor.

(c) The Governor shall have the authority to expand on duties, responsibilities, and powers of the Department of Defense.

Section 3. Amendments

(a) Section 1 of the Gubernatorial Succession Act currently states; Should, for reasons including, but not limited to death, resignation, inability, removal from office, or simple vacancy, there is no Governor capable of discharging the duties the office of Governor of Firestone; then the individual highest on the following list, and is fully eligible and capable of handling the position of Governor of Firestone, shall become the Governor of Firestone:

i. Lieutenant Governor

ii. Speaker of the House of Representatives

iii. President Pro Tempore of the Senate

iv. Speaker Pro Tempore of the House of Representatives

V. Secretary of State

Vi. Attorney General

Vii. Secretary of Homeland Security

viii. Secretary of Public Safety

ix. Secretary of Commerce

x. Secretary of Health

xi. Secretary of Aviation

xii. Secretary of Transportation

xiii. Secretary of Public Works

xiv. Secretary of Boating & Waterways

(b) Section 1 of the Gubernatorial Succession Act shall now state; Should, for reasons including, but not limited to death, resignation, inability, removal from office, or simple vacancy, there is no Governor capable of discharging the duties of the office of Governor of Firestone; then the individual highest on the following list, and is fully eligible and capable of handling the position of Governor of Firestone, shall become the Governor of Firestone:

i. Lieutenant Governor

ii. Speaker of the House of Representatives

iii. President Pro Tempore of the Senate

iv. Speaker Pro Tempore of the House of Representatives

v. Secretary of State

vi. Attorney General

vii. Secretary of Homeland Security

viii. Secretary of Defense

ix. Secretary of Public Safety

x. Secretary of Commerce

xi. Secretary of Health

Section 4. This legislation shall go into effect immediately upon passage and signage by the Governor.
