A BILL
to Amend the “Establishing Obstruction of Justice” Statute


PREAMBLE
Currently, the standing law that defines and outlines “obstruction of justice” has a vague definition and failed to provide key components needed to effectively define the offense of obstruction of justice in the State of Firestone. This amendment shall have the sole purpose of redefining said definition and provide the necessities needed.

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:


SEC. 1.

(a) Subsection “b” and “c” of Section 2 of the statute “Establishing Obstruction of Justice” shall be declared null and shall be replaced by Section 2, with the corresponding subsection of this amendment to the aforementioned statute.

(b) The statute “Establishing Obstruction of Justice” has been defined as: (Establishing Obstruction of Justice).

(c) This amendment shall have the sole purpose of redefining said definition and provide the necessities needed.

SEC. 2.

(a) Subsection “b” of Section 2 of “Establishing Obstruction of Justice” shall be amended to state the following:

  • “(b) The offense of “obstruction of justice” shall be defined as: “The act or threat of preventing official governmental duties of any officer of the court or any law enforcement officer through the act of: tampering with evidence; or, influencing the testimony of any person in a criminal proceeding; or, failing to comply with lawful orders; or, causing any hindrance, delay, or prevention of any action of an officer of the court or law enforcement agency and their entities; or, withholding any component or article at the request of an officer of the court through the proper authority to retrieve such in any criminal proceeding or criminal investigation by the Justice Department and components thereof.”

(b) Subsection “c” of Section 2 of “Establishing Obstruction of Justice” shall be amended to state the following:

  • “© In the field, any law enforcement officer with the power to arrest, shall arrest any person(s) for the violation of this offense which shall hold the punishment of a minimum of three (3) minutes of imprisonment or subsequently fine any person(s) with a citation holding the minimum of three-hundred dollars ($300). Upon successful conviction in a court of law, the accused shall receive a minimum sentence of thirty (30) minutes in the state penitentiary and a maximum sentence of one (1) hour in the state penitentiary.”

SEC. 3.

(a) The Executive Branch shall enforce this statute through the appropriate agencies alongside the enforcement by the Judicial Branch of the State of Firestone.

SEC. 4.

(a) Upon the passage of this legislation by both the Senate and House of Representatives and subsequently being signed by the Governor, this bill shall be made law and go into effect immediately without delay.
