An Act to require explicit statutory establishment of causes of action; and provide for a general cause of action in the violation of the Bill of Rights.


Be it resolved by the Senate and House of Representatives of the State of Firestone in Congress assembled,

SECTION 1. SHORT TITLE

This bill may be known as the “Tort Reform Act”.

SEC. 2. EFFECTIVENESS

This Act shall be effective upon completion of the constitutionally required process.

SEC. 3. SEVERABILITY

Should any part of this Act be struck down or declared unenforceable, then that part of the Act shall be considered severed from this Act, and the rest shall remain in full force.

SEC. 4. EXPLICIT CAUSES OF ACTION

(a) No person may bring a cause of action which has not been explicitly established as a cause of action by Act of Congress.

(b) For the purposes of the previous subsection, a mere reference to enforcement by the courts shall not constitute establishment as a cause of action.

SEC. 5. BILL OF RIGHTS

(a) There is always a cause of action where any provision of the Bill of Rights has been violated, and a Court may therefor order relief necessary to remedy the violation.

(b) The previous subsection shall be preempted by any particular cause of action established by Act of Congress regarding a violation of the Bill of Rights.
