A BILL

to Define Obstruction of a Tow as a Charge

PREAMBLE: Whereas, there is now a larger concequence for those whos vehicles get impounded. Therefore, more people would want to stop DOT from impounding vehicles so that they don’t have to pay a large fee. This law is to set a stricter consequence if anyone decides to try and stop DOT from impounding a vehicle. This charge has been written with the help and recommendation of the Chief Court Justice.

         By virtue of the County Charter of Stapleton County the Council hereby establishes that,

SECTION 1.

For short, this Bill may be cited as “SC Towing Enforcement Act of 2023”

SECTION 2,

Upon passage of this act, this Bill shall go into effect as an Ordinance of the Stapleton County Council upon the completion of the legally required processes.

SECTION 3.

a. For purposes of this act, the ‘Firestone Criminal Code’ shall be defined as: Trello

b. For purposes of this act, the ‘Department of Transportation’ or ‘DOT’ shall be defined as: Firestone Department of Transportation - Roblox

c. For purposes of this act, ‘Interfering with a Public Service Employee’ shall be defined as: Trello

SECTION 4.

a. Chapter 8, Section 3 of the Firestone Criminal Code shall be moved to Chapter 8, Section 4 of the Firestone Criminal Code, and shall be retitled to state “§4 - Contempt of County Council”

SECTION 5.

a. Chapter 8, Section 3 of the Firestone Criminal Code shall be created and shall state “§3 - Obstruction of a Tow”

b. “§3 - Obstruction of a Tow” shall state the following:

“‘Obstruction of a Tow’ shall be recognized as an unlawful criminal offense within Stapleton County.

Obstruction of a Tow shall be the act of obstructing or otherwise intentionally preventing or blocking an employee of the Departnent of Transportation that is driving a Tow Truck from transporting a vehicle on its bed to any vehicle compound in the County. The act of blocking a vehicle from being pulled onto the Tow bed of a DOT Tow Truck shall also be Obstruction of a Tow.

No law enforcement officer may conjunctively arrest a subject for both ‘Interfering with a Public Service Employee’ and ‘Obstruction of a Tow’ regarding the same act committed by the subject."

c. “Obstruction of a Tow” shall be recognized as a Class B Misdemeanor and shall carry a punishment of 250-600 seconds within the Firestone Department of Correction penitentiary or a citation value of $500 FSD.

d. No law enforcement officer may conjunctively arrest a subject for both ‘Interfering with a Public Service Employee’ and ‘Obstruction of a Tow’ regarding the same act committed by the subject.
