IN THE SENATE OF THE STATE OF FIRESTONE
ON THIS 25TH DAY OF OCTOBER 2022
Mr. SirCalebXVI (for himself and Mr. Kamraxn) proposed the following bill:
A BILL
To prevent conflicts of interest or potential bias within the blacklist processes of the Department of Public Safety.Be it enacted by the Senate and the House of Representatives of the State of Firestone in Congress assembled,
§1. Title
(a) This Act shall be known, and may be cited as, “Public Safety Conflicts Amendment”.
§2. Enactment
(a) This Act shall go into effect upon the completion of the constitutionally required processes.
§3. Severability
(a) Should any part of this Act be struck down and/or declared unenforceable, then that part shall be severed with the rest remaining in full force and effect unless all is struck down and/or declared unenforceable.
§4. Enforcement
(a) This Act shall be enforced by any relevant parties.
§5. Definitions
(a) The “Public Safety Act of 2022” shall be defined as this
§6. Repealments
(a) This Act makes no repealments.
§7. Amendments
(a) Section 14(a) of the Public Safety Act of 2022 currently states: "
The Department may, referring to Public Safety Blacklist(s) (“blacklist(s)”), bar any person from employment within one or more of any departments under their jurisdiction, excluding their own, only if the following individuals concur with the blacklist:
(i) The Governor;
(ii) The Secretary of Public Safety;
(iii) The Director of the Firestone Peace Officer Standards and Training Academy;
(iv) The Deputy Secretary of Public Safety (if the position is filled);
(v) The Attorney General."
(b) Section 14(a) of the Public Safety Act of 2022 shall now state: "
The Department may, referring to Public Safety Blacklist(s) (“blacklist(s)”), bar any person from employment within one or more of any departments under their jurisdiction, excluding their own. Such blacklist may be accomplished only through a unanimous concurring vote of specific individuals, unless an individual person obtains a conflict of interest in which that person shall recuse from the vote, and these individuals shall include:
(i) The Governor;
(ii) The Secretary of Public Safety;
(iii) The Director of the Firestone Peace Officer Standards and Training Academy;
(iv) The Deputy Secretary of Public Safety (if the position is filled);
(v) The Attorney General."
