POLL: Do you agree with simplifying murder laws?

Good day to all, it’s your local speaker here;

I’d like to know the publics (!!) opinion on getting rid of the following charges. Currently, each of them respectively can be stacked and charged alongside OTHER charges and really complicates things much more than they need to be. A suggestion was made to nullify these and simplify existing laws.

  1. Assault with a deadly weapon, in the vast majority of cases, is really just an attempt to commit some form of murder. Generally, people don’t attack others with a weapon that can kill them, if they don’t intend to do so.

  1. Negligent homicide is defined by the standard of “criminal negligence”. This is a meaningless and undefined standard, that renders the crime useless when compared to manslaughter.

  1. Attempted murder is useless as an independent crime. The Criminal Code already has a section covering attempts to commit a crime, which can already be used in favor of attempted murder, because it has the exact same punishment and covers the same conduct. Having a separate crime of attempted murder just clutters up the Code.

Removing the section from the criminal code will not make attempted murder legal. Attempted murder is already covered by the attempting to commit a crime section, making the attempted murder section useless.

The only difference is that you have to write “attempted 1st/2nd degree murder”. I have serious concerns if that’s so hard for our law enforcement officers.

Instead of completely removing it just make it so it can’t be charged in conjunction with a murder. There are circumstances where AWADW can be applied without a murder or an attempt thereof. This may be less applicable in the everyday cop scenario but this can come up in court

Negligent Homicide is defined by the standard of “gross negligence,” and once again the small differences may be considered in a court-like setting.

Okay so you say that assault with a deadly weapon is a useless law that should be apart of attempted murder, then go out of your way to say attempted murder is useless? What.

Both fall under attempting to commit a crime. But I think we could keep AWADW to be used for things like being stabbed.
