Perjury Act of 2022

Mr. CITYUSER (for himself, Mr. 1SUPERCHRIS2, Mr. DANNYBEC, Ms. AUTOMATIONEER, Mr. CLONEMEP, and Mr. STAMOSE) introduced the following bill:


A BILL

To repeal the Truthful Testimony Act of 2019 and appropriately define the act of perjury.


         Be it enacted by the Senate and House of Representatives of the State of Firestone in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the “Perjury Act of 2022”.


SEC 2. ENACTMENT.

    This Bill shall go into effect as an Act of Congress upon the completion of the constitutionally required processes.


SEC 3. SEVERABILITY.

    Should any part of this Act be struck down and/or declared unenforceable, then that part shall be severed with the rest remaining in full force and effect unless all is struck down and/or declared unenforceable.


SEC 4. ENFORCEMENT.

    This Act shall be implemented by the Manager of the Criminal Code and enforced by all Courts and other Judicial Bodies of the State of Firestone.


SEC 5. DEFINITIONS.

    (a) For the purposes of this Act, the ‘Firestone Criminal Code’, as described by the Criminal Code Revision Act (R), shall be defined as: https://trello.com/b/EGN3OQzQ

    (b) For the purposes of this Act, the ‘Truthful Testimony Act of 2019’ shall be defined as: https://forums.stateoffirestone.com/t/8199

    (c) For the purposes of this Act, ‘A Bill to Further Prevent Perjury and Affirm the Oath’ shall be defined as: https://forums.stateoffirestone.com/t/8767


SEC 6. REPEALMENTS.

    (a) The Truthful Testimony Act of 2019 shall be repealed in its entirety, and declared null and void.

    (b) A Bill to Further Prevent Perjury and Affirm the Oath shall be repealed in its entirety, and declared null and void.


SEC 7. AMENDMENTS.

    (a) Chapter 6, section 7 of the Firestone Criminal Code shall be amended.

         (i) Chapter 6, section 7 of the Firestone Criminal Code shall now be titled “Perjury”.

         (ii) Chapter 6, section 7 of the Firestone Criminal Code currently states:

"(a) The act of providing false testimony to an official of the government shall be recognized as an unlawful criminal offense within the State of Firestone.

(a1) Providing false testimony to an official of the government shall be the act of providing testimony to an officer of the Firestone Government that the subject knows is false- or otherwise willfully lying, after the subject has sworn to honesty before the official (or entity) in question, as prescribed by the Constitution and other legislation.

(a2) Swearing to honestly shall be the act of affirming the following oaths of honesty-

(i) “Do you solemnly swear, that you will tell the truth, and nothing but the truth, so help you God?”, or;

(ii) “Do you solemnly swear that you are telling the whole truth, and nothing but the truth, or else face contempt of court?”

Further oaths may be dictated by existing, or further legislation."

         (iii) Chapter 6, section 7 of the Firestone Criminal Code shall be amended to state:

"(a) The act of perjury shall be recognized as an unlawful criminal offense within the State of Firestone.

(a1) Perjury shall be the act of providing testimony under penalty of perjury that the individual believes is false to any government entity.

(a2) Testimony is provided under penalty of perjury after affirming or swearing to an oath of honesty administered by an employee, official, or other officer of the government. Written testimony may be provided to a government entity under penalty of perjury if such is affirmed or declared by the individual."

         (iv) Chapter 6, section 7 of the Firestone Criminal Code shall remain a Class C Felony and a Courts Only offence.
