Good Samaritan Law Act

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS* HERE ASSEMBLED THAT:

PREAMBLE: In order to ensure the better safety of Citizens within the State of Firestone this act is being established.

§1: In formal matters, this act will be cited as the “Samaritan Law of 2019”.

  • §1.1: Hereinforth, “first aid” shall be defined as checking heart-rate, checking respirations, checking airway, attending to non-lethal bleeding/cuts/bruises. Also providing chest-compressions to an individual if the patient has no pulse.

§2: Citizens will be able to express the virtues set within this act; Law Enforcement may not arrest/cite any citizen for merely expressing a virtue set within this act. Though the citizens will be required to follow the restrictions set within the sections of this act. Should an officer arrest an individual for conveying a virtue set within this act they may be sued within the courts for “False Arrest”. Though should an individual commit a crime whilst exercising virtues set within this act they may still be arrested/cited for the crime they committed.

  • §2.1: All citizens of the State of Firestone shall have the ability to render first aid at the scene of an accident, casualty, or disaster to a person injured therein. Furthermore, upon Emergency Medical Services’ (EMS) arrival at the scene, the citizen must yield to the EMS personnel and allow them to treat the patient; alongside handing over any information they obtained before EMS arrived. Forbye, the citizen may not be liable for any civil damages as a result of them not wishing to provide first aid to the patient.

  • §2.C: Should the actions of an individual rendering first aid lead to the death of an individual, they may be tried in the court of law for the charge of Medical Malpractice and manslaughter. Should an individual rendering first aid cause more injury to an individual, they may be tried in the courts for the charge of Medical Malpractice. The courts shall determine if the individual rendering first aid was doing so to assist or to act in malice.

§3: This legislation shall go into effect upon being passed from both chambers of Congress.
