District Police Establishment Act of 2022

BE IT ENACTED BY THE DISTRICT OF PROMINENCE COUNCIL HERE ASSEMBLED THAT:

PREAMBLE
(a) Whereas it has been found by the District Council that the establishment of the Prominence District Police is imperative for the preparation of V3 release as it has been confirmed by the Founder that each municipality within Stapleton County will have a local police department.
(b) Therefore, the District Police Establishment Act shall be established.

SECTION 1 - ESTABLISHMENT

(a) The Prominence District Police shall be established under the Executive Branch of the District of Prominence.
(b) The authority of the Prominence District Police shall be established through superior legislation.
(c) The Prominence District Police shall be responsible for security of Prominence and enforcement of municipal, state, and county laws.
(d) The Prominence District Police shall exist as the following group:

SECTION 2 - STRUCTURE

(a) The Prominence District Police shall be led by a Chief of Police who shall be designated as an Employee of the Executive Branch of Prominence, or as Executive Staff.
(i) The Chief of Police shall be subject to nomination by the Mayor and confirmation by the District Council.
(b) The Chief of Police shall have the authority, subverted by no one other than the Mayor of the District of Prominence, to staff and appoint any structure of command, ranks, policies, etc., within the District Police Department.
(i) However, the Chief of Police shall be required to appoint an Assistant Chief of Police, who shall serve as their deputy, as an Employee of the Executive Branch of Prominence, or Executive Staff, and act as Chief of Police in their absence.
(ii) The rank structure has already been determined by the Founder; therefore, it shall be as follows:

(1) Chief of Police

(2) Assistant Chief of Police (3) Lieutenant
(4) Sergeant
(5) Corporal
(6) K9 Officer (7) Officer
(8) Recruit
(iii) Policies or directives issued by the Chief of Police or anyone designated the authority to do so shall not conflict or violate the rights of an employee granted by superior legislation.

SECTION 3 - EMPLOYMENT, APPOINTMENT, AND HIRING

(a) Any citizen within the State of Firestone, excluding those employed within a primary department already, shall have the ability to seek employment within the Prominence District Police when applications are being accepted. In order for someone to be eligible for employment, they must meet the following requirements:

(i) Hold a certification from the Peace Officer Standards and Training Academy,
(ii) Have no active blacklists from the Department of Public Safety,
(iii) Have no arrests on record and no more than two misdemeanor citations,
(iv) Not to be employed in another primary department as defined by superior
legislation.
(v) Any further requirements shall be determined by the Chief of Police.
(b) Outside hiring or “free ranking” shall be prohibited.
(i) No one shall be hired into the department without taking an application open
to the public unless it is approved by the Mayor.
(ii) Furthermore, no one should be permitted to be promoted more than three (3)
ranks unless approved by the Mayor.

SECTION 4 - TIMEFRAME OF LEGISLATIVE IMPLEMENTATION

(a) The District Police Establishment Act shall go into effect immediately following the completion of the required procedure as described by the District Chater.

SECTION 5 - MODE OF NULLIFICATION

(a) Should any part of this Act be struck down and/or declared unenforceable, then that part shall be severed with the rest remaining in full force and effect unless all is struck down and/or declared unenforceable.
