Crimes Against Humanity (Proposed Bill by Bird_Owly)

This bill proposes the creation of a series of guidelines regarding armed conflicts between two or more military parties. This bill shall be referred to as the Firestone Bill of Crimes Against Humanity. VERSION 1

Section 1 - Definitions
1.1 A military force shall be defined as a group, party, or entity that uses violence or violent methods to gain a political or economic objective. A military force includes but is not limited to an official military, a militia, a militant group, a crime organization, and/or any similar group or entity.

1.2 A war shall be defined as any armed conflict where one or more entities that are categorized as a military force use violence against another entity or group of individuals to gain a political objective. This includes but is not limited to a rebellion, a riot, an insurrection, an act of treason, and/or any other situation that is similar.

1.3 A violent act shall be defined as an act that causes bodily harm to another individual. This can be with or without a weapon.

Section 2 - Limitations
2.1 Any entity or group that uses violence to achieve a political or economic objective against the State of Firestone, an official entity that represents the government of Firestone, commits an act of violence or engages in a war in Firestone, or has ties to the State of Firestone while engaging in violence or war for a political or economic objective shall be automatically required to follow this bill.

2.2 If such a group falls under 2.1, they shall only be judged, trialed, and punished under this bill of reasonable suspicion or evidence is found to accuse such group of having violated this bill.

2.3 All accused individuals of such group or entity have the right to a free and fair trial. Individuals have the right to hire an attorney to defend themselves in such situation.

2.4 All accused shall be given the right to view any evidence used against them. Furthermore, all individuals shall not be punished by any respective group or entity under the State of Firestone until proven guilty.

Section 3 - Crimes Against Military Forces
3.1 A crime committed against another military force shall be defined as the act of violating one or more sub-sections within this section

3.2 Individuals accused of having violated this section can only be trialed if proven that they were a part of a military force while having committed such violation.

3.3 Groups accused of violations in this section must be proven to have been a military force while committing such violation of this section.

3.4 While engaging in an act of war, all military forces must abide by all guidelines listed in this section.

3.5 Military forces engaging in an act of war against another military force may not force captured individuals of the opposing military force into fighting or serving the main force.

3.6 Military forces who engage in war may not fake a surrender. All surrenders must be valid. Similarly, military forces may not use any violent tactics or methods to attack a surrendering military force. Instead, they must capture the force and arrest them on behalf of the State of Firestone.

3.7 Individuals part of a military force who are taken captive as prisoners must be treated according to the legal code of Firestone. Such individuals shall not be collectively punished, treated inhumanly, given cruel or unusual punishments, abused, or otherwise have had their basic rights as listed in the Firestone Constitution.

3.8 Military forces taken captive must be given proper food, proper shelter, drinkable water, basic clothing, and the right to speak to an attorney in Firestone.
