Civil Office Definition Act of 2018
A bill to reform Civil Service throughout the State and to provide for which positions are to be considered civil offices.

Be it enacted by the Senate and House of Representatives of the State of Firestone in Congress Assembled,

SECTION I. SHORT TITLE; GENERAL PROVISIONS.

  1. Short Title. — This Act may be cited as the “Civil Office Definition Act of 2018”.
  2. Severability. — This Act shall be severable, such that if any word, phrase, line, sentence, or provision of this Act, or the application of any of them to any person or circumstance, is held invalid, their application to other persons or circumstances, and the remainder of this Act shall not be affected thereby. Any newer law shall not supersede this Act unless that law specifically declares its intent to supersede this Act’s provisions.
  3. Effective Date. — This Act shall go into effect immediately following enactment.

SECTION II. CIVIL OFFICES DEFINED

  1. The following offices in the Department of Justice shall be declared civil offices throughout the State of Firestone;

  2. Attorney General

  3. Deputy Attorney General

  4. The following offices in the Department of Homeland Security​ shall be declared civil offices throughout the State of Firestone;

  5. Secretary of Homeland Security

  6. Deputy Secretary of Homeland Security

  7. The following offices in the Department of State shall be declared civil offices throughout the State of Firestone;

  8. Secretary of State

  9. Deputy Secretary of State

  10. The following offices in the Department of Public Safety shall be declared civil offices throughout the State of Firestone;

  11. Secretary of Public Safety

  12. Deputy Secretary of Public Safety

  13. The following offices in the Department of Commerce shall be declared civil offices throughout the State of Firestone;

  14. Secretary of Commerce

  15. Deputy Secretary of Commerce

  16. The following offices in the Department of Transportation shall be declared civil offices throughout the State of Firestone;

  17. Secretary of Transportation

  18. Deputy Secretary of Transportation

  19. The following offices in the Department of Public Works shall be declared civil offices throughout the State of Firestone;

  20. Secretary of Public Works

  21. Deputy Secretary of Public Works

  22. The following offices in the Department of Health shall be declared civil offices throughout the State of Firestone;

  23. Secretary of Heath

  24. Deputy Secretary of Health

  25. The following offices in the Department of Aviation shall be declared civil offices throughout the State of Firestone;

  27. Deputy Secretary of Aviation

  28. The following offices in the Firestone State Patrol shall be declared civil offices throughout the State of Firestone;

  29. Superintendent

  30. Colonel

  31. The following offices in the Firestone National Guard​ shall be declared civil offices throughout the State of Firestone;

  32. Major General

  33. Brigadier General

  34. The following offices in the Department of Corrections shall be declared civil offices throughout the State of Firestone;

  35. Warden

  36. Assistant Warden

  37. The following offices in the Firestone Peace Officer Standards and Training​ shall be declared civil offices throughout the State of Firestone;

  38. Director

  39. Deputy Director

  40. The following offices in the Firestone Fire Academy​ shall be declared civil offices throughout the State of Firestone;

  41. Director

  42. Deputy Director

  43. The following offices in any municipality​ shall be declared civil offices in the State of Firestone;

  44. County Executive of any municipality;

1. or any reasonable equivalent.
  1. County council member of any municipality;
1. or any reasonable equivalent.
  1. Mayor of any municipality;
  2. Deputy Mayor of any municipality;
  3. City council member of any municipality;
  4. Police Chief of any municipality;
1. or any reasonable equivalent.
  1. Deputy Police Chief of any municipality;
1. or any reasonable equivalent.
  1. Chief of Fire Department of any municipality;
1. or any reasonable equivalent.
  1. Deputy Chief of Fire Department of any municipality;
1. or any reasonable equivalent.
  1. The following offices in the Office of the Governor​ shall be declared civil offices throughout the State of Firestone;

  2. Governor of the State of Firestone

  3. Lieutenant Governor of the State of Firestone

  4. Chief of Staff to the Governor

  5. The following offices in the Legislative Branch​ shall be declared civil offices throughout the State of Firestone;

  6. Speaker of the House

  7. President Pro Tempore

  8. Speaker Pro Tempore

  9. Senate Clerk

  10. House Clerk

  11. Senator

  12. Representative

  13. The following offices in the Judicial Branch​ shall be declared civil offices throughout the State of Firestone;

  14. Chief Court Justice

  15. Associate Justice of the Supreme Court

  16. Appeals Court Justice

  17. District Court Justice

  18. Chief Bailiff

SECTION III. PROHIBITION;​ ​FUTURE​ ​CIVIL​ ​OFFICES; INCUMBENTS.

  1. It shall be prohibited for any person who is serving in one civil office to hold another civil office.

  2. The District Court is authorized to use whatever writs necessary to compel the compliance of subsection (a).

  3. The Attorney General has the authority to pursue individuals in the District Court for violations of this act to ensure its enforcement.

  4. Any future civil offices must be declared by Congress.

  5. Current incumbents shall be bound by the provisions put forth in this section and in the previous section.
