Charter Amendment To Remove Bars
Preamble: Removing The Barring Of Anyone From The District Of Prominence
BE IT ENACTED BY THE DISTRICT COUNCIL HERE ASSEMBLED THAT,
SECTION 1
Article 4, Section 11 of the District Charter currently states,
“The Mayor, Deputy Mayor and District Council shall have the ability to bar individuals from holding executive offices within the government of the District of Prominence. A District Executive bar shall be a restriction on holding any executive branch office within the government of the District of Prominence. A District Executive bar shall be proposed in the same way as an Ordinance, however can only pass with a super-majority (4⁄5) vote. A District Executive bar can be nullified with a 4⁄5 vote of the District Council. Anyone permitted to propose a bar shall not be allowed to bar any individual during an election period or any individual that is holding a position within the government of the District of Prominence at that time”
SECTION 2
Article 4, Section 12 of the District Charter currently states,
“The Mayor, Deputy Mayor and District Council shall have the ability to bar individuals from holding legislative offices within the government of the District of Prominence. A District Legislative bar shall be a restriction on holding legislative branch positions within the government of the District of Prominence. A District Legislative bar shall be proposed in the same way as an Ordinance, however can only pass with a super-majority (4⁄5) vote. A District Legislative bar can be nullified with a simple-majority (1⁄2) vote of the District Council. Anyone permitted to propose a bar shall not be allowed to bar any individual during an election period or any individual that is holding a position within the government of the District of Prominence at that time.”
SECTION 3
Article 4, Section 12 shall now be nullified and deemed void.
SECTION 4
Article 4, Section 11 shall be re-titled as “Section 11. Prohibition of District Bars” and shall be amended to state,
“No person may be barred from holding government office in the District of Prominence, with the exception of any applicable bar lawfully imposed by a superior government.”
SECTION 5
Article 4, Section 13 of the District Charter is currently titled, “Section 13. District Council Elections”.
SECTION 6
Article 4, Section 13 of the District Charter shall be re-classified as Article 4, Section 12 and shall be re-titled as, “Section 12. District Council Elections”.
SECTION 7
This District Charter Amendment shall go into effect immediately upon passing the legal processes as described by the District Charter.
