Charter Amendment to Change Ordinance Majority

BE IT ENACTED BY THE DISTRICT OF PROMINENCE COUNCIL HERE ASSEMBLED THAT,

SECTION 1

Article IV, Section 8 of the Prominence District Charter currently states:

“The District Council may vote on proposals and other matters during sessions. The Presiding Officer of the session shall determine what proposal or other matter is to be discussed and/or voted on at what time. Before voting starting on a proposal or other matter the Presiding Officer shall open the floor to debate. A proposal for an Ordinance shall pass the District Council with a simple-majority (1⁄2) vote. Other matters that are not specified by law to require a certain amount of votes to pass the District Council shall pass the District Council with a simple-majority (1⁄2) vote. Those with the authority to vote shall deliver a vote of Aye, meaning they are in favor of the matter, Nay, meaning they are not in favor of the matter, or Abstain, which means they do not have an opinion on the matter. The Presiding Officer of a session shall not have the ability to vote on a matter, except at such a time when the vote of the present Councilmembers ends in a tie. Should the vote still be tied after a vote by the Presiding Officer, the present Councilmembers, excluding the Presiding Officer should they be a Councilmember, shall once again vote, but without the ability to vote Abstain on the matter. If this vote once again ends up in a tie, the Presiding Officer may break such a tie with a vote of Aye or Nay.”

SECTION 2

Article IV, Section 8 of the Prominence District Charter shall be amended to state,

Other matters that are not specified by law to require a certain amount of votes to pass the District Council shall pass the District Council with a simple-majority (1⁄2) vote. Those with the authority to vote shall deliver a vote of Aye, meaning they are in favor of the matter, Nay, meaning they are not in favor of the matter, or Abstain, which means they do not have an opinion on the matter. The Presiding Officer of a session shall not have the ability to vote on a matter, except at such a time when the vote of the present Councilmembers ends in a tie. Should the vote still be tied after a vote by the Presiding Officer, the present Councilmembers, excluding the Presiding Officer should they be a Councilmember, shall once again vote, but without the ability to vote Abstain on the matter. SECTION 3

This District Ordinance shall go into effect immediately upon passing the legal processes as described by the District Charter.
