Charter Amendment for Article III Section VIII

Preamble: Changing “Legal intern” to “Paralegal”


BE IT ENACTED BY THE CITY OF ARBORFIELD COUNCIL HERE ASSEMBLED THAT,

SECTION 1

This document shall be legally empowered and binding upon the completion of the process set out by the City Charter.

SECTION 2

Should any part of this document be struck down and/or declared unenforceable, then that part shall be severed with the rest remaining in full force and effect unless all is struck down and/or declared unenforceable.

SECTION 3

Article III Section VIII currently states,

“The office of the Arborfield City Attorney shall be established as an executive office and entity within the City of Arborfield’s Executive Branch. The Arborfield City Attorney’s Office shall be composed of one (1) City Attorney, two (2) Assistant City Attorney, and no more than two (2) Legal interns. The City Attorney shall have full responsibility for the duties of the Arborfield City Attorney’s Office as prescribed by this charter or other legislation, however, they may delegate tasks or duties to other members of the Arborfield City Attorney’s Office. The City Attorney is authorized to grant their authority to other members of the City Attorney’s Office when required, and this authorization has full legal force when in effect. The City Attorney shall have the power to (a) Investigate members of the executive or legislative branches (as prescribed by Section 14 of the Arborfield City Charter), (b) investigate any departments, offices, or other organizations legally established by mayoral decree or legislation and directly or indirectly managed by the City of Arborfield (as prescribed by Section 14 of the Arborfield City Charter), and (c) Suspend specific, or all, powers granted to an individual by law or this charter during an investigation. The Arborfield City Attorney’s Office is responsible for all legal needs of the city, and exclusively represents the City of Arborfield and any offices, departments, or other organizations directly or indirectly controlled or managed by the City of Arborfield. The City Attorney must (1) possess a bar certification, (2) be nominated by the Mayor, and (3) pass a confirmation vote by the City Council. The Assistant City Attorney(s) must possess a bar certification. The City Attorney shall have full authority to appoint and remove members of the Arborfield City Attorney’s Office as they see fit.”

SECTION 3A

Article III Section VIII shall now state,
