Charter Amendment to Aid Succession
Preamble: In the case of an event to where succession becomes nearly impossible, thse charter changes will form a better succession.
BE IT ENACTED BY THE DISTRICT OF PROMINENCE COUNCIL HERE ASSEMBLED THAT,
SECTION 1
Article III, Section 10 of the Prominence Chartee currently states, “
Should the office of Deputy Mayor of the District of Prominence be vacant during a term, the Mayor may nominate an individual for the position of Deputy Mayor of the District. The Mayor may only nominate citizens of the State of Firestone to serve as the Deputy Mayor. The Mayor may nominate one (1) individual at a time for the position of Deputy Mayor. The Mayor may at any time retract a nomination, except for when such a nomination has already been voted on by the District Council or is being voted on by the District Council. The District Council has to confirm the nomination with a super-majority (4⁄5) vote. Once the nomination has been confirmed by the District Council, the nominated individual shall gain the position of Deputy Mayor of the District of Prominence. If the vote for the nomination instead fails the District Council, the individual shall not gain the position of Deputy Mayor of the District of Prominence and may not be nominated again during the same vacancy of the office of Deputy Mayor of the District of Prominence, however the Mayor is permitted to nominate an individual whose nomination they retracted earlier in the case that this nomination was not voted on by the District Council. The Mayor may also instead nominate another individual. The Mayor cannot nominate a Deputy Mayor within fourteen (14) days of his/her term ending.”
SECTION 2
Article III, Section 10 of the Prominence Charter shall now state, “
Should the office of Deputy Mayor of the District of Prominence be vacant during a term, the Mayor may nominate an individual for the position of Deputy Mayor of the District. The Mayor may only nominate citizens of the State of Firestone to serve as the Deputy Mayor. The Mayor may nominate one (1) individual at a time for the position of Deputy Mayor. The Mayor may at any time retract a nomination, except for when such a nomination has already been voted on by the District Council or is being voted on by the District Council. The District Council has to confirm the nomination with a super-majority (4⁄5) vote. Once the nomination has been confirmed by the District Council, the nominated individual shall gain the position of Deputy Mayor of the District of Prominence. SECTION 3
Article III, Section 11 of the Prominence Charter currently states: “
Should the office of the Mayor of the District of Prominence become vacant during a term, whether that be through resignation, expulsion or other events, the Deputy Mayor may assume the office of Mayor of the District of Prominence. The District Council must confirm such through a super-majority (4⁄5) vote. If this confirmation passes, the Deputy Mayor of the District shall gain the office of the Mayor of the District of Prominence and shall vacate the office of Deputy Mayor of the District of Prominence. If this confirmation fails the District Council or if the office of the Deputy Mayor of the District of Prominence is also vacant, the operations of the Executive Branch of the District of Prominence shall be halted, until such a time when the office is the Mayor is occupied, and proposals of Ordinances passed by the District Council shall be frozen in place and only forwarded to the Mayor at such a time when the office of the Mayor is occupied. Additionally, the County Executive shall host special elections for the position of Mayor of the District pursuant to Section 8 of this Article.”
SECTION 4
Article III, Section 11 of the Prominence Charter shall now state: “
Should the office of the Mayor of the District of Prominence become vacant during a term, whether that be through resignation, expulsion or other events, the Deputy Mayor may assume the office of Mayor of the District of Prominence.”
This District Ordinance shall go into effect immediately upon passing the legal processes as described by the District Charter.
