ESTABLISHMENT OF

BUSINESS EMPLOYEE PROTECTION ACT

PREAMBLE: To establish protection for business employees and harsher punishment for those who commit crimes against a member of an established business which posses a valid commerce permit.

By virtue of the County Charter of Stapleton County the Council hereby establishes that,

SECTION I. CITING

a. This Bill may be cited as the “Business Employee Protection Act," or the “BEPA.”

SECTION II. ENACTMENT

a. Upon passage of this act, this Bill shall go into effect as an Ordinance of the Stapleton County Council upon the completion of the legally required processes.

SECTION III. DEFINITIONS

a. The “Commerce Permit Database” shall be defined as this “trello board."
b. The “Firestone Criminal Code” or “FCC” shall be defined as this “trello board.”
c. The “Department of Commerce” shall be defined as members of this group holding the rank of “Public Affairs Office” or higher.

SECTION IV. ESTABLISHMENT

a. Chapter 8, Section 6 of the Firestone Criminal Code shall be established and state: “§6 - Violence Against a Business Employee”
b. “§6 - Violence Against a Business Employee” shall state:

"a. ”Violence Against a Business Employee” shall be recognized as an unlawful criminal offence within Stapleton County.

a1. The act of attempting to injure, or injuring a member of a business with an active business permit issued by the Department of Commerce as displayed by the Commerce Permit Database.

a2. The usage of assaultive or abusive language, and shows intent of potential escalation to an assaultive action and creates an environment which is likely to inflict injury upon another."

c. “Violence Against a Business Employee” shall carry a punishment of a Class A Misdemeanor and be punishable ranging between 400 to 500 seconds in a correctional facility.

a. Chapter 8, Section 7 of the Firestone Criminal Code shall be established and state “§7 - Disruption of a Business”
b. “§7 - Disruption of a Business” shall state:
"a. “Disruption of a Business” shall be recognized as an unlawful criminal offence within Stapleton County.

a1. The act of causing a disturbance including an unreasonable audible noise, obstructing an an employee of a business licensed by the Department of Commerce from conducting any duties required of them by their business, or otherwise interfering or hindering a businesses operations.

a2. The act of causing unreasonable public alarm on the property of a business licensed by the Department of Commerce."

c. “Disruption of a Business” shall carry a punishment of a Class A Misdemeanor and be punishable of 450 seconds in a correctional facility.

a. Chapter 8, Section 8 of the Firestone Criminal Code shall be established and state: “§8 - Interfering with a Commerce Event”
b. “§8 - Interfering with a Commerce Event” shall state:
"a. “Disruption of a Business” shall be recognized as an unlawful criminal offence within Stapleton County.

a1. Causing an obstruction or hinderance resulting in an obstruction, or otherwise prevention of duties of an employee of the Department of Commerce during the hosting or attendance of a public event."
c. “Interfering with a Commerce Event” shall carry a punishment of a Class B Misdemeanor and be punishable of up to 400 seconds in a correctional facility and/or a citation of $200 FSD.

SECTION V. ENFORCEMENT

a. The following departments, agencies, or similar must enforce the above law(s) as listed in Section IV.

i. The Stapleton County Sheriff’s Office
ii. The Stapleton County Port Authority
iii. The Arborfield Police Department
iv. The Redwood Police Department
v. The Prominence District Police

SECTION VI. SEVERABILITY

a. In the event that any portion of this act be struck down and/or declared unenforceable, then that part shall be severed with the rest remaining in full force and effect unless all is struck down and/or declared unenforceable.
