An Amendment to Officially Define “LOVID”
PREAMBLE: Since “LOVID” is not defined in law correctly, this will be defining it for courts.
BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:
SECTION 1: “An Act to Simplify False Arrest and False Citation” shall be defined as this.
SECTION 2: Section 3 of “An Act to Simplify False Arrest and False Citation” shall be amended to state,
“False Arrest shall be defined as the act of a law enforcement officer:
(3a.) arresting an individual for an offense that isn’t recognized by law;
(3b.) arresting an individual for an offense when probable cause does not exist;
(3c.) overtiming the arrestee for the charge(s) being used for the arrest;
(3d.) or filling out the required sections of, as defined in Section 7 of this bill, the arrest report incorrectly”
SECTION 3: Section 4 of “An Act to Simplify False Arrest and False Citation” shall be amended to state,
“A false citation shall be defined as the act of a law enforcement officer:
(4a.) issuing an individual a citation for an unrecognized traffic violation or crime;
(4b.) issuing an individual a citation for a traffic violation or crime when probable cause does not exist;
(4c.) overcharging the individual receiving the citation;
(4d.) or filling out the required sections of, as defined in Section 7 of this bill, the citation report incorrectly”
SECTION 4: Section 7, subsection i of “An Act to Simplify False Arrest and False Citation” shall be created and state,
“(7i) Arrest Report shall be defined as an area where the arresting officer must put the time arresting for, the offence(s) committed, the arresting officer’s callsign, and the time and date of the arrest. The arresting officer may put the location (street name) of the arrest, the arresting officer’s name (along with any assisting officers), and the venue (general area) of the arrest in the Arrest Report.”
SECTION 4: Section 7, subsection j of “An Act to Simplify False Arrest and False Citation” shall be created and state,
**“(7j) Citation Report shall be defined as an area where the citing officer must put the amount of money citing for, the offence citing for, the citing officers callsign, and the time and date of the citation. The citing officer may put the venue (general area) of the arrest, the citing officer’s name (along with any assisting officers), and the venue (general location) of the citation in the Citation Report.”
SECTION 5: Section 6 of “An Act to Simplify False Arrest and False Citation” shall be amended to state,
“Whereas a Law Enforcement Officer misspells an offense or charge during the filling of an arrest report or citation report, the misspelled charge(s) or offense(s) shall be recognized as the closest offense the officer was trying to write down.”
SECTION 6: Should any part of this legislation be constructed by any judicial body of this state to be unconstitutional and declared unenforceable then that part shall be severed with the rest of the act remaining in full force and effect.
SECTION 7: This legislation shall be brought into law, given that it follows the procedures to do so, as outlined by the Constitution.
