An Amendment to Establish County Chairperson Elections

PREAMBLE: This amendment seeks to establish an election system, similar to that of the Speaker of the House, for the position of County Chairperson. This would replace the current system in which they are appointed by the County Executive.

By virtue of the County Charter of Stapleton County, the Council hereby establishes that,

SECTION I. TITLE
(a) This amendment shall be known, and may be cited as, “An Amendment To Establish County Chairperson Elections”.

Section II. DEFINITIONS
(a) The position of County Chairperson shall be defined as the head of the County Legislative Branch.

(b) The ‘Stapleton County Charter’ or ‘County Charter’ shall be defined as the file attached on “Trello"

SECTION III. AMENDMENTS

(a) Article II, Section I, Subsection D of the County Charter shall be amended.

(b) Article II, Section I, Subsection D of the County Charter currently states:

The County Executive shall, at the beginning of each term, or at such a time when the position may become vacant, nominate one (1) Councilmember to serve as the County Chairperson. The County Chairperson shall be confirmed by the County Council by a simple majority (½) vote. Should the sitting County Chairperson win reelection, they shall not be reappointed to the position of Chairperson, unless renominated by the County Executive and confirmed by the Stapleton County Council.

(c) Article II, Section I, Subsection D of the County Charter shall be amended to state:

The County Council shall, at the beginning of each term, or at such a time when the position may become vacant, under an election hosted by the County Executive of Stapleton County choose one Councilmember to serve as the County Chairperson. Should the sitting County Chairperson win reelection to the County Council, they shall not be reappointed to the position of Chairperson, unless reelected by the County Council.

SECTION IV. ENFORCEMENT

(a) This amendment shall be enforced by all relevant parties.

SECTION V. SEVERABILITY

(b) Should any part of this amendment be struck down and/or declared unenforceable, the rest of the amendment will remain in effect unless also struck down and/or declared unenforceable.
