An Amendment to Correct a Conflict within the District Charter

Preamble: A prior Charter amendment by T_xom has left a conflict within the District Charter that simultaneously allows and denies executive branch employees to be expelled.


BE IT ENACTED BY THE DISTRICT OF PROMINENCE COUNCIL HERE ASSEMBLED THAT,

SECTION 1

Article III Section 12 of the District Charter currently states:

‘The Mayor shall hold the ability to nominate and/or appoint individuals to the executive offices within the Executive Branch of the District, which shall be established through appropriate legislation. Legislation that establishes (one of these) offices shall specify whether a nomination or appointment is necessary for an individual to hold the positions within that office or those offices. Positions that require a nomination by the Mayor shall need to be confirmed by the District Council through a simple-majority (1⁄2) vote. Appointments do not need additional confirmations, apart from a decision and/or statement by the Mayor. The Mayor shall additionally hold the ability to dismiss and/or terminate those individuals who are a part of an executive office or multiple executive offices within the District’s Executive Branch. Employees of the Executive Branch may also be impeached or expelled by the District Council through the process(es) defined in Article V of this Charter.’

SECTION 3

This Charter amendment shall go into effect immediately upon passing the legal processes as described by the District Charter.
