An Act to Make Battery on a Police Officer a Charge!

PREAMBLE
Currently Battery on a Police Officer is not a charge. Battery on a Police Officer
should become a Felony charge in Stapleton County.
BY VIRTUE OF THE COUNTY CHARTER OF STAPLETON COUNTY THE COUNCIL HEREBY ESTABLISHES THAT:
SECTION 1.
- The Firestone Criminal Code shall be defined as this.
SECTION 2.

Chapter 8, Section 2 of the Criminal Code Board shall be created and shall state “§2 - Battery on a Police Officer”

“Battery on a Police Officer” shall state the following:

““Battery on a Police Officer" shall be recognized as an unlawful criminal offense within Stapleton County.

“Battery on a Police Officer” shall be the act of unlawful application of force directly or indirectly upon a certified On-Duty Law Enforcement Officer, as defined by applicable legislation, causing bodily injury or offensive contact.

This may not be applied alongside the charge of battery or assault with a deadly weapon for the same act.”

“Battery on a Police Officer” shall be recognized as a Class C Felony and shall carry a punishment of 500 seconds within the Firestone Department of Corrections penitentiary.
SECTION 3.
Upon passage of the Stapleton County Council and signature by the County Executive, this bill shall be effective as County law immediately.
