An Act To Establish the Firestone Department of Aviation

AN ACT

To Establish the Firestone Department of Aviation

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED
THAT:

SECTION 1. Establishment

(a) The State of Firestone Aviation Department shall be recognized as an official
department of the state; and shall serve under the Firestone Executive Branch. The
aviation department shall have the duties of managing all operations pertaining to the air
– this includes, but is not limited to: investigating, regulating, and anything else that the
Secretary of Aviation deems necessary that pertains to aviation. They shall also have
authority over any airfields, or anything that generally regards the Department of Aviation.
Citizens of the state may be prosecuted for contravening the regulations of the Aviation
Department, due to its high-profile violation. Any citizen must oblige to the standards and
customs presented by the Firestone Department of Aviation if pertaining to aviation.

(b) The Firestone Department of Aviation shall be led by a Secretary. The Secretary of the
department must be nominated by the Governor of the State of Firestone, and shall pass a
Senate confirmation with a simple-majority by the Senate; the Secretary may be dismissed
from his or her position at any time by the Governor, or may be removed through the
procedure of impeachment.

(c) The Firestone Department of Aviation shall be known to be under the Firestone
Executive Branch; thus, the Governor shall have the authority to make administrative
actions towards the aviation department, and may set respective policy and rules that must
be set through verbal communication, executive orders or other ethical ways of policy.

(d) The Firestone Department of Aviation shall be defined as the following group:

SECTION 2. AUTHORITY AND RESPONSIBILITIES

(a) The Firestone Department of Aviation shall have the full authority to manage all
operations, procedure, or other circumstances in the airspace. They shall also have the
ability to regulate and control the airspace with policies that must be followed by anyone
wishing to preside in the air, or shall face prosecution for violating aviation policy if
necessary.

(b) The Firestone Department of Aviation shall have the ability to manage all aviation
related companies and airlines, as well as managing all airfields. The department may
investigate any and all incidents relating to pilots, aircrafts, airfields, and air
transportation of any kind.

(c) The Firestone Department of Aviation shall be tasked with ensuring the safety of
citizens that are aboard any aircraft of anytime; this includes the airspace in general, along
with everything within it, as well as the property and people under it. Failure to ensure the
safety of others from the aviation department will result in respective sanction. With this
responsibility, the entire department shall be put at hand to be held responsible during any
aviation crisis.

SECTION 3. POLICY AND REGULATION

(a) The Secretary of the Firestone Department of Aviation shall be responsible for the
pertinent management and administration of the department itself, as well as the
regulation for the department, and so shall the Secretary have the responsibility to ensure
the guidelines and regulation of the Firestone aviation department are imposed. The
Secretary of Aviation shall be considered the leader of the aviation department.

(b) As noted in Section 1(c) of this act, the Governor shall have the sole power to take
administrative actions towards as well as within the Firestone Department of Aviation, and
any set policy or regulation that is imposed by the Governor, must be obliged by the
Department of Aviation.

SECTION 4. STAFF

(a) All employment positions within the Firestone Department of Aviation shall be regarded
as secondary positions; although the Deputy Secretary and Secretary of the Firestone
Department of Aviation shall be regarded as primary positions. The Secretary of Aviation
shall be considered a Cabinet position, as the Deputy Secretary shall be considered
“Sub-Cabinet”.

(b) The Firestone Department of Aviation is obliged to ensure the upkeep of the
department, as well as ensure the safety and being of others to the best possible standard.
The Department of Aviation shall be held responsible for any crisis that is in regards to
aviation.

SECTION 5. AMBIGUOUS TERMS

(a) Airspace, or air shall be defined as: Space available for aircraft flight above the ground.
Aircraft shall be defined as: Any vehicle with the capability of flight. Airfields shall be
defined as an area designated for the taking off, landing, and servicing of aircraft.

SECTION 6. This legislation shall be superintended to by the Governor of the State of
Firestone, and shall be enforced and imposed by the Firestone Department of Aviation.

SECTION 7. Upon passing both chambers of Congress, as well as being signed by the
Governor of the State of Firestone, this legislation shall go into effect immediately.

SECTION 8. All laws in conflict with this legislation are hereby declared null and void.
