In Congress,
§1. Upon passage by the required processes, this constitutional amendment shall be enacted with immediate effect.
§2. Article III, Section VII, Subsection VII of the Constitution currently states, “No person shall twice be put in jeopardy of criminal or civil liability for the same offense or wrong, except in cases where there is a mistrial, appellate reversal, or dismissal without prejudice.”
§3. Article III, Section VII, Subsection VII of the Constitution shall be amended to state, “No person shall twice be put in jeopardy of criminal or civil liability for the same offense or wrong, except in cases where there is a mistrial, appellate reversal, or dismissal without prejudice. Arrests and executed arrest warrants that were not expunged or sealed on the basis of being false shall equally count as criminal liability, alongside convictions.”
