A Charter Amendment to Allow Council Discretion

Preamble: To allow the City Council more flexibility in impeachments and expulsions. The City Council is a check by the people, for the people. As such, the City Council should have the authority to determine if someone is fit for office.


BE IT ENACTED BY THE CITY OF ARBORFIELD COUNCIL HERE ASSEMBLED THAT,

SECTION 1

This document shall be legally empowered and binding upon the completion of the process set out by the City Charter.

SECTION 2

Should any part of this document be struck down and/or declared unenforceable, then that part shall be severed with the rest remaining in full force and effect unless all is struck down and/or declared unenforceable.

SECTION 3

  1. Whereas Article V, Section 5 currently states “An individual who is being impeached must have committed a crime, been inactive without notice, failed to execute their duties properly, betrayed the public trust, or committed another bad, harmful, or otherwise atrocious act against the City of Arborfield, Stapleton County, or the State of Firestone. An individual who committed a crime or is accused of committing a crime may only be impeached and may not be expelled. An individual who is being expelled must have been inactive without notice, failed to execute their duties properly, betrayed the public trust, or committed another bad, harmful, or otherwise atrocious act against the City of Arborfield, Stapleton County, or the State of Firestone. If the applicable requirements for impeachment or expulsion are not met, no impeachment or expulsion proceedings may be brought against a person. Individuals who have previously had an impeachment/expulsion proposal against them with the same listed offences AND evidence, they cannot be tried again within the same term.”
  2. Whereas Article V, Section 5, will now state “An individual may be impeached by the City Council for any reason. An individual who committed a crime or is accused of committing a crime may only be impeached and may not be expelled. An individual who is being expelled must have been inactive without notice, failed to execute their duties properly, betrayed the public trust, or committed another bad, harmful, or otherwise atrocious act against the City of Arborfield, Stapleton County, or the State of Firestone. If the applicable requirements for expulsion are not met, no expulsion proceedings may be brought against a person.
