A Bill To Prevent Misuse of Interim County Offices

PREAMBLE

BY VIRTUE OF THE COUNTY CHARTER OF STAPLETON COUNTY THE COUNCIL HEREBY ESTABLISHES THAT:

SECTION 1.

The County Charter shall be defined as this document.

County Offices shall be defined as County Executive, Sheriff, Fire Chief, District Attorney, and other offices created via Executive Order otherwise not mentioned in the County Charter.

SECTION 2.

In the case of removal, resignation, impeachment, or other means, in any office mentioned in Section 1, the County Executive may appoint an interim official into office. Any person who assumes interim duties shall retain all duties established in the County Charter.

The County Executive may, at his or her discretion, appoint any person who is qualified for interim duties of offices established in Section 1.

To prevent the misuse of interim duties, the County Executive must, after a reasonable period of time set by the County Chairperson, shall submit a formal nomination to the Stapleton County Council.

SECTION 3.

If the County Executive fails to nominate any individual after the timeframe set by the County Chairperson, the Stapleton County Council may compel, in writing, the County Executive to nominate an individual.

Should the County Executive need additional time to find a qualified candidate, he or she may request written additional time to the County Chairperson.

SECTION 4.

In the event the County Executive does not comply with the Stapleton County Council, the Stapleton County Council may remove the interim official if deemed absolutely necessary;

Section IV subsection A, of the County Charter, currently states: “Expulsion shall be defined as the process by which the Stapleton County Council votes to remove an

individual from office. The Stapleton County Council shall have the authority to present an expulsion against another member of the Stapleton County Council, the County Chairperson, a member of the County Legislation Review Committee, or a member of the County Executive’s Executive Staff, not to include members of the Cabinet or Sub-Cabinet. All expulsions shall require a supermajority (⅔) vote by the Stapleton County Council to pass.”

Section IV subsection A, of the County Charter, shall be amended to state: “Expulsion shall be defined as the process by which the Stapleton County Council votes to remove an individual from office. SECTION 5.

Upon passage of this bill from the Stapleton County Council and signature of the County Executive, this bill shall go into immediate effect.
