A BILL

to Define Misuse of Public Office

PREAMBLE: Whereas, wording of existing law does not restrict current government officials from misusing their office for an intent that may harm others or the government body they serve, going against their oath of office. Existing law requires personal gain. This law was written under the advisement of legal experts.

         By virtue of the County Charter of Stapleton County the Council hereby establishes that,

SECTION 1.

a. For short, this Bill may be cited as “A Bill to Define Misuse of Public Office”

SECTION 2,

a. Upon passage of this act, this Bill shall go into effect as an Ordinance of the Stapleton County Council upon the completion of the legally required processes.

SECTION 3.

a. The ‘Firestone Criminal Code’ shall be defined as: Trello

b. For purposes of this act, “Government Office” refers to any official position or role within a government body. This includes but is not limited to elected offices, appointed positions, administrative roles, regulatory authorities, law enforcement agencies, public service departments, and any other entity or institution established by law to carry out governmental functions within a particular jurisdiction.

SECTION 4.

a. Chapter 8, Section 5 of the Firestone Criminal Code shall be created and shall state “§5 - Misuse of Public Office”

b. “§5 - Misuse of Public Office” shall state the following:

“(a) ‘Misuse of Public office’ shall be recognized as an unlawful criminal offense within Stapleton County.

(b) Misuse of Public Office shall be defined as abuse or immoral misuse of a government office."

c. “Misuse of Public office” shall be recognized as a Class B Misdemeanor and shall carry a punishment of 600 seconds within the Firestone Department of Corrections penitentiary.
