A Bill to Amend the Public Property Act

BE IT ENACTED BY THE STATE OF FIRESTONE CONGRESS HERE ASSEMBLED THAT:

Preamble: This act is being amended in order to allow DOC full access to their island. Many terrorist attacks have occurred that could have been prevented by allowing DOC full access to their restricted area. This legislation shall make DOC Island and the bridge that connects to the island no longer public property and is subject restrictions from the public.

SECTION 1A: Public Property Act, Section 2, shall be amended.

SECTION 1B: A Bill to Amend the Public Property Act shall be defined as Public Property Act

SECTION 2A: Section 2 of the Public Property Act shall now state:

(Subsection I) Public Property shall be defined as a region or locality of which is owned and maintained by the government of the State of Firestone, of which is available for free access by all individuals located within the state.

(Subsection II) No entity shall intentionally restrict access, or attempt to intentionally restrict access, to any sort of public property, unless:

(I) The restriction is acted upon via the orders of the Governor, be it by any authoritative announcement as defined within the Constitution.

(II) There is an emergent situation that requires a portion of Public Property
restricted in order to resolve said situation, though this may be called off by
the Governor, or the department head of the law enforcement agency in question
or a respective supervisor designated to do such by said department head, or;

(III) As a law enforcement checkpoint, done rarely for a reasoning being
absolutely plausible, when authorized by the Governor or the department head of
the law enforcement agency in question or a respective supervisor designated to
do such by said department head.

(IV) The property is surrounded by restricted air or waters deemed by legislation or executive order. This would make all docks, islands, roads, bridges, and any other structures or lands subject to the department in charge of the restricted area and will NOT be Public Property.

(V) The restriction is acted upon for the sake of plausible maintenance of said public property,
such as, but not limited to, that done by the Department of Transportation as
well as that of the Department of Public Works.

SECTION 3A: The term/entity as written in this legislation, the “Department of Transportation”, shall be defined as the members of this group:

SECTION 3C: The term “law enforcement checkpoint” shall be defined via Article V Section IV of the Firestone Consitution.

SECTION 4: This legislation shall be enforced by the Firestone Executive Branch.

SECTION 5: This legislation shall go into effect immediately after passage from both chambers.
