The Employee Safety Net Act

BE IT ENHANCED BY THE STATE OF FIRESTONE CONGRESS THAT:

PREAMBLE: In order to further protect employees within the state both within the private sector and public sector of the State of Firestone, this congress shall enact a system to allow those punished by discrepancies of Law Enforcement to allow for a better system of employee safety.

Section 1: The Employee Safety Net Act shall be created.

Section 2: Henceforth, any individual employed within the Executive Branch or any business licensed by the Department of Commerce shall be permitted various protections following an arrest to submit proceedings to a court of law to challenge said arrest.

Section 3: Such individuals as described in Section 2 shall first be provided a buffer period following their arrest to file legal proceedings to challenge said arrest. This buffer period shall last twenty-four (24) hours. During this buffer period, the employee must only be suspended from their position and may not be removed from their position. The employee shall not be permitted to exercise any functions of their employment during the buffer period. This protection may be waived if the individual in question agrees to waive it.

Section 3A: This protection may be bypassed by the Governor of the State of Firestone.

Section 3B: Once the time has passed in the buffer period, the protection as prescribed in Section 3 shall be revoked only if the individual in question has not filed any legal proceedings to challenge said arrest.

Section 3C: If the individual violates their suspension and performs any of their functions of their employment during the period, this protection shall be voided.

Section 4: Such individuals as described in Section 2 shall also be provided a stasis period. This statis period shall be enacted once the individual in question has submitted legal proceedings to challenge said arrest. This stasis period shall last till the individual in question has received a verdict on their case. During the stasis period, the individual in question shall remain suspended from their position and may not be removed from their position. They also shall not be permitted to conduct any functions of their employment during the period.

Section 4A: This protection may be bypassed by the Governor of the State of Firestone.

Section 4B: Once a verdict is given by a judge in regards to their case, the protection as prescribed in Section 4 shall be revoked.

Section 4C: If the individual violates their suspension and performs any of their functions of their employment during the period, this protection shall be voided.

Section 5: From the start of the buffer period to the end of the stasis period, if the individual in question is arrested again during either of the period, all protections provided in this act shall be voided.

Section 6: This shall be enforced by the Governor of the State of Firestone, any cabinet of the respective departments of the Executive Branch of Firestone and the owner of any business licensed by the Department of Commerce.

Section 7: Should any part of this legislation be deemed unconstitutional or struck down, the rest of this act shall retain amiability.

Section 8: This act shall go in effect twenty-four (24) hours following the completion of the requirements set for passage of legislation as set by the Constitution.
